the housing authority will advise the person, and if applicable, their advocate, thatsupports are available from the HSE and will, where requested and, followingconsent, refer the person to the appropriate contact point in the HSE.10. The housing authority will in<strong>for</strong>m the person of the reasons <strong>for</strong> the need to providemedical evidence of their condition to support their housing application, i.e. in orderto assess their housing application, determine appropriate prioritisation <strong>for</strong> theprovision of housing services and to ensure that offers of support are, in so far as ispossible, appropriate to the specific needs of the person. It should be clearlyoutlined that the provision of suitable housing services will be subject to availabilityand the operation of the relevant housing authority’s Scheme of Letting Priorities /Allocations Scheme 137 .11. In all cases, it is desirable that written consent regarding the exchange of in<strong>for</strong>mationis obtained from the person <strong>with</strong> a mental health disability. However, where theperson <strong>with</strong> a mental health disability gives verbal consent only, this should berecorded in writing. Consent may also be accepted from a designated advocate inline <strong>with</strong> the wishes of the person <strong>with</strong> a mental health disability. The requirementsof data protection legislation will be fully complied <strong>with</strong> in relation to the provisionand use of personal in<strong>for</strong>mation.12. In order to assist in the sustainment of tenancies 138 , the HSE shall, <strong>with</strong> the consentof the person <strong>with</strong> a mental health disability, in<strong>for</strong>m the relevant housing authoritywhere the person is being hospitalised as a result of their disability and will be absentfrom their dwelling.13. This protocol shall be subject to review in line <strong>with</strong> the extension of Part 2 of the<strong>Disability</strong> Act, 2005 to all age groups.14. This protocol has been adopted <strong>for</strong> implementation <strong>with</strong> effect from 8th March <strong>2011</strong>.137<strong>Housing</strong> authorities are required to replace individual Schemes of Letting Priorities <strong>with</strong> new AllocationsSchemes by June <strong>2011</strong>, as provided <strong>for</strong> in the <strong>Housing</strong> (Miscellaneous Provisions) Act, 2009.138This relates to local authority or RAS tenancies.162
