• Advise the person bringing the claim, in writing, <strong>of</strong> the matters regarding counseling and thatthe person may have an individual who serves as that person’s advisor (at no expense to the<strong>University</strong>) as the claim is processed by the Response Team. Such an advisor may be presentat any proceedings <strong>of</strong> the Response Team, but shall not act as an advocate and shall not bepermitted to present arguments or to in any way turn the process into an adversarial one,such as by presenting testimony or statements <strong>of</strong> another person or by cross-examiningwitnesses.• Advise, in person and in writing, the person accused <strong>of</strong> sexual harassment <strong>of</strong> theaccusation(s) in the claim. This shall normally be done within two days <strong>of</strong> receiving thewritten claim. Such person also may have an advisor as described in the paragraphimmediately above.• Give due consideration to policy matters relating to disciplinary actions which are in progressor may be initiated by applicable judicatories.• Hold a fair and impartial inquiry and submit a written report to the Dean.• Maintain confidentiality with regard to claims and proceedings, revealing substantive mattersinvolved in the processing <strong>of</strong> a claim only as provided in this policy or as required by law.Prohibited Actions - The Response Team shall not:• Advocate for any party involved in a claim.• Act as legal counsel.• Act as counselors or “advisors” (as referred to earlier in this policy) for those involved inthe claim.• Enforce any specific remedy or disciplinary action.Fair and Impartial Inquiry - The Response Team shall conduct a fair and impartial inquiry.This inquiry shall include at a minimum:• A meeting with the person submitting the claim to insure that the person is familiar with thispolicy and to hear matters pertaining to the claim.• A meeting with the person accused in the claim to insure that the person is familiar with thispolicy and is afforded the opportunity to respond to the allegation(s).• Taking the statements <strong>of</strong> any witnesses who can provide directly relevant information.The inquiry may, but need not include:• A meeting at which both the claimant and the person accused are present, together with anyadvisors.• Pr<strong>of</strong>essional opinions <strong>of</strong> qualified experts, with any costs to be approved beforehand by theDean.117
