ResponseUpon receipt <strong>of</strong> a claim <strong>of</strong> sexual harassment against a faculty/staff member, the Director <strong>of</strong>Human Resources shall submit the matter to the appropriate Dean (unless the claim is againstthe Dean in which case it will then be submitted to the President <strong>of</strong> the <strong>University</strong>. In such asituation, the President shall take the action normally assigned to the Dean in this policy, andwhen action is defined as discretionary, the President may take action at his or her discretion)as defined in the next section <strong>of</strong> this policy and to state or federal authorities, as may be requiredby law.Upon receipt <strong>of</strong> a claim <strong>of</strong> sexual harassment against a student or faculty/staff member, theappropriate Dean will initiate the investigation and hearing process, which may result in <strong>of</strong>ficial<strong>University</strong> disciplinary action. Seminary students, please consult additional response proceduresin Seminary section.Effect <strong>of</strong> Withdrawal <strong>of</strong> ClaimA claim may be withdrawn in writing, and at the discretion <strong>of</strong> the Dean, the matter will beconsidered closed, with no further action required pursuant to this policy.Anti-Retaliation StatementRetaliation <strong>of</strong> any kind against anyone filing a complaint <strong>of</strong> sexual harassment is prohibited.Initiating a complaint <strong>of</strong> sexual harassment will not affect a student’s grades, class selection, orany other matter pertaining to student status including employment, compensation, or workassignments.Distinguishing between sexually harassing conduct and conduct that is purely personal or socialwithout a discriminatory work or educational effect requires a determination based on all thefacts pertaining to the situation in order to avoid injury to innocent people. Initiating a false sexualharassment complaint or initiating a sexual harassment complaint in bad faith may result indisciplinary action. A finding for the accused does not constitute a finding that the complaint wasin bad faith.MEDIA RELATIONS AND UNIVERSITY PUBLICATIONSAll <strong>University</strong> media contact (press, television, radio, etc.) shall be coordinated through theOffice <strong>of</strong> <strong>University</strong> Relations. All faculty and staff should direct any and all media contacts byreporters or account representatives to the Director <strong>of</strong> Public Information in the <strong>of</strong>fice <strong>of</strong><strong>University</strong> Relations.The proper names <strong>University</strong> <strong>of</strong> <strong>Dubuque</strong> and <strong>University</strong> <strong>of</strong> <strong>Dubuque</strong> Theological Seminary aretrademarked, are the exclusive property <strong>of</strong> the corporate entity, the <strong>University</strong> <strong>of</strong> <strong>Dubuque</strong>, andcan not be used by other individuals or organizations without its consent.All publications directed to an <strong>of</strong>f-campus audience must be processed through the Office <strong>of</strong><strong>University</strong> Relations in the Charles and Romona Myers Center (e.g. text approval, designdirection, and production).
