If required to do so by law, the matter shall be referred to appropriate legal authorities by theDean. The Dean may refer matters to appropriate judicatories. Referral <strong>of</strong> any matter to legalauthorities, to judicatory <strong>of</strong>ficials, or to both, shall not preclude the Dean or other <strong>University</strong>authority from taking appropriate action <strong>of</strong> behalf <strong>of</strong> the <strong>University</strong>/Seminary.Media RelationsProvision <strong>of</strong> information to media (press, television, radio, etc.) about sexual harassment casesshall be done in conjunction with the <strong>University</strong> Relations Office. Members <strong>of</strong> the response teamshall not provide such information directly to any media. Confidentiality shall be respected to thefullest extent possible.Right <strong>of</strong> Claimant to Other ProceduresNothing herein is intended to prohibit or discourage an individual who believes he or she hasbeen aggrieved from pursuing remedial action from any proper authority or from seeking anypastoral or other assistance.Community Awareness <strong>of</strong> PolicyOrientation ProgramsFaculty, staff, and students are strongly encouraged to include information about this policy inorientation programs for new students.ConflictIf any conflict arises between the Seminary sexual harassment policy and the <strong>University</strong> policy,the <strong>University</strong> policy will take precedence.Anti-retaliation StatementRetaliation <strong>of</strong> any kind against anyone filing a complaint <strong>of</strong> sexual harassment is prohibited.Initiating a complaint <strong>of</strong> sexual harassment will not affect a student’s grades, class selection, orany other matter pertaining to student status including employment, compensation, or workassignments.Distinguishing between sexually harassing conduct and conduct that is purely personal or socialwithout a discriminatory work or educational effect requires a determination based on all thefacts pertaining to the situation in order to avoid injury to innocent people. Initiating a falsesexual harassment complaint or initiating a sexual harassment complaint in bad faith may resultin disciplinary action. A finding for the accused does not constitute a finding that the complaintwas in bad faith.119
