EKSPROPRIATION OF REAL ESTATE AFFECTED BY NATURAL
DISASTERS
ABSTRACT: Expropriation is one in a series of legal institutes for which the state reaches in
order to cope, among other things, and with the consequences of natural disasters or how they
could be prevented. Due to the fact that through this institute delves into one of the basic
human rights - the right to property, and that in this regard different abuses are possible, to
the level that this institute is used for the purpose of realizing the repressive management
mode, it is necessary appropriate legal regulations to be established. In this paper we will
point out the characteristics of this form of expropriation, the legal nature and process in
which expropriation are realized, with the aim of determining to which extent the solutions
that deviate from the general regime of expropriation are aligned with the needs and risks
arising from various forms of natural disasters and the demand for preventive action or
urgency reactions.
