- Part 3 - Advocacy on <strong>the</strong> <strong>right</strong> <strong>to</strong> <strong>water</strong> <strong>and</strong> <strong>sanitation</strong> <strong>in</strong> emergencies<br />

The Committee attaches great importance <strong>to</strong> cooperation with NGOs at local, national <strong>and</strong> <strong>in</strong>ternational<br />

levels whe<strong>the</strong>r or not <strong>the</strong>y have been accorded advisory status with<strong>in</strong> <strong>the</strong> Economic <strong>and</strong> Social Council.<br />

It constantly encourages <strong>the</strong>se organizations <strong>to</strong> take part <strong>in</strong> its activities with <strong>the</strong> aim of re<strong>in</strong>forc<strong>in</strong>g <strong>the</strong> effectiveness<br />

of <strong>in</strong>ternational follow-up of <strong>the</strong> implementation of <strong>the</strong> Covenant. 132 The Committee recognizes<br />

<strong>the</strong> important contribution that NGOs can make <strong>in</strong> provid<strong>in</strong>g <strong>in</strong>formation about <strong>the</strong> status of <strong>the</strong> Covenant<br />

with<strong>in</strong> States parties. On <strong>the</strong> first day of each session of <strong>the</strong> Committee, <strong>the</strong> afternoon meet<strong>in</strong>g is set aside<br />

for NGOs who can present ei<strong>the</strong>r written or oral declarations. The active participation of NGOs <strong>in</strong> <strong>the</strong> work<br />

of <strong>the</strong> Committee has proved essential <strong>in</strong> ensur<strong>in</strong>g wide distribution of <strong>in</strong>formation about <strong>the</strong> Covenant<br />

<strong>and</strong> <strong>the</strong> Committee at <strong>the</strong> national level. However, it is obvious that this process, which only takes place<br />

once every five years for <strong>the</strong> States parties hav<strong>in</strong>g ratified <strong>the</strong> Covenant, is not really adapted <strong>to</strong> <strong>emergency</strong><br />

<strong>situations</strong>, which often dem<strong>and</strong> rapid <strong>in</strong>tervention, even <strong>in</strong> terms of advocacy. Never<strong>the</strong>less, it is important<br />

<strong>to</strong> know that this option is available.<br />

Moreover, if at present <strong>the</strong>re is no procedure allow<strong>in</strong>g <strong>in</strong>dividuals or groups <strong>to</strong> submit a compla<strong>in</strong>t for violation,<br />

a number of organizations are recommend<strong>in</strong>g that such a procedure be set <strong>in</strong> place 133 . But f<strong>in</strong>ally, on<br />

a more <strong>in</strong>formal basis, whilst <strong>the</strong> CESCR is free <strong>to</strong> consider a letter from an <strong>in</strong>dividual, it is unlikely <strong>to</strong> study<br />

such a letter formally, except as part of <strong>the</strong> documents it reviews when ga<strong>the</strong>r<strong>in</strong>g evidence about economic,<br />

social <strong>and</strong> cultural <strong>right</strong>s <strong>in</strong> a particular State. If serious <strong>and</strong> widespread abuses of Covenant <strong>right</strong>s<br />

are seen <strong>to</strong> be occurr<strong>in</strong>g <strong>in</strong> a particular country, an NGO may wish <strong>to</strong> immediately <strong>in</strong>form <strong>the</strong> CESCR, by<br />

fax, letter, or e-mail message <strong>to</strong> its Secretariat. In rare cases <strong>the</strong> CESCR or its Chair may decide <strong>to</strong> contact<br />

an offend<strong>in</strong>g State without wait<strong>in</strong>g for its next periodic review. An NGO is more likely <strong>to</strong> receive a rapid<br />

response <strong>to</strong> an <strong>emergency</strong> appeal if it contacts several <strong>in</strong>dividuals <strong>and</strong> organizations. Possibilities <strong>in</strong>clude<br />

<strong>the</strong> follow<strong>in</strong>g: sources <strong>in</strong>side <strong>the</strong> country where <strong>the</strong> violations are occurr<strong>in</strong>g (M<strong>in</strong>isters responsible; At<strong>to</strong>rney<br />

General/M<strong>in</strong>ister of Justice; Foreign M<strong>in</strong>ister; receptive politicians <strong>and</strong> relevant parliamentary committees;<br />

supportive NGO coalitions; <strong>the</strong> courts (<strong>to</strong> seek an <strong>in</strong>junction or o<strong>the</strong>r order halt<strong>in</strong>g harmful activity); embassies<br />

of countries known <strong>to</strong> champion relevant <strong>human</strong> <strong>right</strong>s; pr<strong>in</strong>t, broadcast <strong>and</strong> media journalists) <strong>and</strong><br />

sources outside <strong>the</strong> country (OHCHR, NGOs such as Amnesty International, etc., which operate urgent<br />

action networks or services); <strong>human</strong> <strong>right</strong>s supervisory bodies of regional organizations; <strong>the</strong> foreign m<strong>in</strong>istries<br />

of countries known <strong>to</strong> champion <strong>the</strong> relevant <strong>human</strong> <strong>right</strong>s 134 .<br />

14.3.8. Alert o<strong>the</strong>r un moni<strong>to</strong>r<strong>in</strong>g bodies<br />

O<strong>the</strong>r moni<strong>to</strong>r<strong>in</strong>g bodies, such as <strong>the</strong> CEDAW or <strong>the</strong> CRC, can also be alerted, particularly when specific<br />

groups such as women or children are be<strong>in</strong>g subjected <strong>to</strong> violations of <strong>the</strong>ir <strong>right</strong> <strong>to</strong> <strong>water</strong> <strong>and</strong> <strong>sanitation</strong>.<br />

The treaties moni<strong>to</strong>red by <strong>the</strong>se two committees provide <strong>the</strong> most substantial guarantees for <strong>the</strong> various<br />

components of <strong>the</strong> <strong>right</strong> <strong>to</strong> <strong>water</strong> <strong>and</strong> <strong>sanitation</strong>.<br />

Cultural Rights”, which sets out <strong>the</strong> salient po<strong>in</strong>ts of such participation<br />

These compla<strong>in</strong>ts, known as “petitions”, would be reviewed by <strong>the</strong> CESCR on a case-by-case basis. An Optional Pro<strong>to</strong>col<br />

permitt<strong>in</strong>g <strong>in</strong>dividual compla<strong>in</strong>ts of Covenant violations has been drafted, but not approved<br />
