ICESCR, under IHL. This<br />

appears <strong>to</strong> be a confirmation<br />

of <strong>the</strong> exist<strong>in</strong>g provision <strong>in</strong><br />

IHL for fresh <strong>water</strong>, prisoners<br />

of war, <strong>and</strong> civilians suffer<strong>in</strong>g<br />

<strong>the</strong> effects of warfare..<br />

Obligation <strong>to</strong> fulfil (States)<br />

GC 15 refers <strong>to</strong> <strong>emergency</strong><br />

<strong>situations</strong>, especially under<br />

<strong>the</strong> obligation <strong>to</strong> fulfil which<br />

appeals <strong>to</strong> each State<br />

<strong>to</strong> adopt mechanisms <strong>to</strong><br />

respond <strong>to</strong> <strong>emergency</strong><br />

<strong>situations</strong> <strong>and</strong> <strong>to</strong> focus on<br />

mechanisms aimed at <strong>the</strong><br />

anticipation of emergencies<br />

<strong>and</strong> cont<strong>in</strong>gency plann<strong>in</strong>g.<br />

International obligations<br />

Accord<strong>in</strong>g <strong>to</strong> GC 15, <strong>in</strong> disaster<br />

relief <strong>and</strong> <strong>emergency</strong><br />

relief, <strong>in</strong>clud<strong>in</strong>g that provided<br />

<strong>to</strong> refugees <strong>and</strong> displaced<br />

people, priority should be given<br />

<strong>to</strong> <strong>right</strong>s under ICESCR,<br />

such as <strong>the</strong> provision of<br />

adequate <strong>water</strong>.<br />

Responsibility of o<strong>the</strong>r<br />

ac<strong>to</strong>rs than States<br />

Para. 22 - “The Committee notes that dur<strong>in</strong>g armed conflicts, <strong>emergency</strong><br />

<strong>situations</strong> <strong>and</strong> natural disasters, <strong>the</strong> <strong>right</strong> <strong>to</strong> <strong>water</strong> embraces<br />

those obligations by which States parties are bound under International<br />

Humanitarian Law. This <strong>in</strong>cludes protection of objects <strong>in</strong>dispensable for<br />

survival of <strong>the</strong> civilian population, <strong>in</strong>clud<strong>in</strong>g dr<strong>in</strong>k<strong>in</strong>g <strong>water</strong> <strong>in</strong>stallations<br />

<strong>and</strong> supplies <strong>and</strong> irrigation works, protection of <strong>the</strong> natural environment<br />

aga<strong>in</strong>st widespread, long-term <strong>and</strong> severe damage <strong>and</strong> ensur<strong>in</strong>g that<br />

civilians, <strong>in</strong>ternees <strong>and</strong> prisoners have access <strong>to</strong> adequate <strong>water</strong>”.<br />

Para. 28 - “States parties should adopt comprehensive <strong>and</strong> <strong>in</strong>tegrated<br />

strategies <strong>and</strong> programmes <strong>to</strong> ensure that <strong>the</strong>re is sufficient <strong>and</strong><br />

safe <strong>water</strong> for present <strong>and</strong> future generations. Such strategies <strong>and</strong> programmes<br />

may <strong>in</strong>clude: (…) (h) response mechanisms for <strong>emergency</strong><br />

<strong>situations</strong>”.<br />

Para. 34 - “(…) In disaster relief <strong>and</strong> <strong>emergency</strong> assistance, <strong>in</strong>clud<strong>in</strong>g<br />

assistance <strong>to</strong> refugees <strong>and</strong> displaced persons, priority should be given<br />

<strong>to</strong> Covenant <strong>right</strong>s, <strong>in</strong>clud<strong>in</strong>g <strong>the</strong> provision of adequate <strong>water</strong>. International<br />

assistance should be provided <strong>in</strong> a manner that is consistent with<br />

<strong>the</strong> Covenant <strong>and</strong> o<strong>the</strong>r <strong>human</strong> <strong>right</strong>s st<strong>and</strong>ards, <strong>and</strong> susta<strong>in</strong>able <strong>and</strong><br />

culturally appropriate. The economically developed States parties have<br />

a special responsibility <strong>and</strong> <strong>in</strong>terest <strong>to</strong> assist <strong>the</strong> poorer develop<strong>in</strong>g States<br />

<strong>in</strong> this regard”.<br />

Paragraph 60 refers <strong>to</strong> <strong>emergency</strong> <strong>situations</strong> reaffirm<strong>in</strong>g <strong>the</strong> central role<br />

that <strong>human</strong>itarian aid agencies, <strong>the</strong> Red Cross <strong>and</strong> Red Crescent Movement<br />

<strong>and</strong> <strong>in</strong>ternational organizations are play<strong>in</strong>g. However, <strong>the</strong> obligations<br />

of <strong>the</strong>se ac<strong>to</strong>rs are not precisely described. (See Box 10)<br />
