Explicit<br />

recognition<br />

at <strong>the</strong><br />

constitutional<br />

level<br />

The <strong>right</strong> <strong>to</strong> <strong>water</strong> may be explicitly recognized as a basic <strong>right</strong> with<strong>in</strong> a country’s Constitution.<br />

Some States have <strong>in</strong>scribed <strong>the</strong> <strong>right</strong> <strong>to</strong> <strong>water</strong> <strong>in</strong> <strong>the</strong>ir Constitutions, acknowledg<strong>in</strong>g it<br />

<strong>and</strong> mak<strong>in</strong>g it a basic <strong>right</strong> without wait<strong>in</strong>g for <strong>the</strong> outcome of debates on this subject <strong>and</strong>/<br />

or <strong>the</strong> adoption of United Nations General Comment 15. Ultimately, implementation is <strong>the</strong><br />

responsibility <strong>and</strong> duty of <strong>the</strong> State that on <strong>the</strong> one h<strong>and</strong> needs <strong>to</strong> encourage <strong>the</strong> adoption<br />

of adequate legislation def<strong>in</strong><strong>in</strong>g <strong>the</strong> ways <strong>in</strong> which constitutional pr<strong>in</strong>ciples will be applied,<br />

<strong>and</strong> on <strong>the</strong> o<strong>the</strong>r <strong>to</strong> promote <strong>the</strong> development of basic public services.<br />

Table 8 shows by cont<strong>in</strong>en (Africa, Asia <strong>and</strong> Lat<strong>in</strong> America) those develop<strong>in</strong>g countries that have <strong>in</strong>cluded<br />

<strong>the</strong> <strong>right</strong> <strong>to</strong> <strong>water</strong> <strong>and</strong> <strong>sanitation</strong> <strong>in</strong> <strong>the</strong>ir Constitutions, <strong>in</strong>dicat<strong>in</strong>g <strong>the</strong> country, <strong>the</strong> year of adoption of <strong>the</strong><br />

Constitution <strong>and</strong> <strong>the</strong> articles referr<strong>in</strong>g <strong>to</strong> this <strong>right</strong>.<br />

dr<strong>in</strong>k<strong>in</strong>g <strong>water</strong>, of satisfac<strong>to</strong>ry quality <strong>and</strong> <strong>in</strong> sufficient quantity. Art. 66: Each person shall<br />

have <strong>the</strong> <strong>right</strong> <strong>to</strong> basic sanitary facilities.<br />

Africa<br />

(1996), Section 27: (1) (a) Everyone has <strong>the</strong> <strong>right</strong> <strong>to</strong> have access <strong>to</strong> health care services,<br />

take reasonable legislative <strong>and</strong> o<strong>the</strong>r measures, with<strong>in</strong> its available resources, <strong>to</strong> achieve<br />

<strong>the</strong> progressive realization of each of <strong>the</strong>se <strong>right</strong>s.<br />
