on a framework of <strong>right</strong>s <strong>and</strong> duties <strong>and</strong> stresses <strong>the</strong> obligation, especially of States, <strong>to</strong> respect, apply <strong>and</strong><br />

protect <strong>the</strong>se <strong>right</strong>s, even <strong>in</strong> <strong>situations</strong> of <strong>emergency</strong>. In May 2003, <strong>the</strong> United Nations Development Programme<br />

(UNDP) issued a “Statement of Common Underst<strong>and</strong><strong>in</strong>g” <strong>in</strong> which it expla<strong>in</strong>ed that: “<strong>in</strong> a <strong>human</strong><br />

<strong>right</strong>s-based approach, <strong>human</strong> <strong>right</strong>s determ<strong>in</strong>e <strong>the</strong> relationship between <strong>in</strong>dividuals <strong>and</strong> groups with valid<br />

claims (<strong>right</strong>s-holders) <strong>and</strong> State <strong>and</strong> non-state ac<strong>to</strong>rs with correlative obligations (duty-bearers). It works<br />

<strong>to</strong>wards streng<strong>the</strong>n<strong>in</strong>g <strong>the</strong> capacities of <strong>right</strong>s-holders <strong>to</strong> make <strong>the</strong>ir claims, <strong>and</strong> of duty-bearers <strong>to</strong> meet<br />

<strong>the</strong>ir obligations 109 .” Box 18 reflects <strong>the</strong> ma<strong>in</strong> objectives of a <strong>right</strong>s-based approach.<br />

- Streng<strong>the</strong>n <strong>the</strong> underst<strong>and</strong><strong>in</strong>g of <strong>right</strong>s, i.e., underst<strong>and</strong><strong>in</strong>g <strong>the</strong> location, forms <strong>and</strong> perpetra<strong>to</strong>rs<br />

of <strong>right</strong>s violations; recogniz<strong>in</strong>g who is vulnerable <strong>and</strong> assess<strong>in</strong>g degrees of vulnerability; <strong>and</strong> recogniz<strong>in</strong>g<br />

exist<strong>in</strong>g power imbalances <strong>in</strong> society;<br />

- Ensure accountability <strong>and</strong> transparency by identify<strong>in</strong>g <strong>right</strong>s-holders (<strong>and</strong> <strong>the</strong>ir entitlements) <strong>and</strong><br />

correspond<strong>in</strong>g duty-bearers (<strong>and</strong> <strong>the</strong>ir obligations);<br />

- Build capacities for <strong>the</strong> realization of <strong>right</strong>s so that <strong>right</strong>s-holders can make claims <strong>and</strong> dutybearers<br />

can meet <strong>the</strong>ir obligations;<br />

- Facilitate <strong>the</strong> active <strong>and</strong> mean<strong>in</strong>gful participation of multiple stakeholders, <strong>in</strong>clud<strong>in</strong>g people who<br />

directly benefit from projects through access <strong>to</strong> development processes <strong>and</strong> <strong>in</strong>stitutions, improved<br />

<strong>in</strong>formation, legal redress, <strong>and</strong> o<strong>the</strong>r positive strategies;<br />

- Create a sense of ownership of development processes through strategies of empowerment<br />

that focus on <strong>right</strong>s-holders both directly <strong>and</strong> through <strong>the</strong>ir advocates <strong>and</strong> civil society organizations;<br />

<strong>and</strong><br />

- Encourage <strong>the</strong> expression of <strong>right</strong>s through different mediums of communication <strong>and</strong> <strong>in</strong>teraction<br />

with people across regions.<br />

To put this concept <strong>in</strong><strong>to</strong> practice <strong>in</strong> an <strong>emergency</strong> context requires that a clear dist<strong>in</strong>ction be made between<br />

“<strong>right</strong>s” <strong>and</strong> “needs.” Thus, <strong>the</strong> basic need for <strong>water</strong> <strong>and</strong> <strong>sanitation</strong> <strong>to</strong> be able <strong>to</strong> live <strong>in</strong> dignity is<br />

seen as a fundamental <strong>human</strong> <strong>right</strong>, which, <strong>in</strong> turn, implies that when <strong>human</strong>itarian agencies engage with<br />

people, for <strong>the</strong> latter this is not a privilege, not charity, but a <strong>right</strong>. Ano<strong>the</strong>r critical feature of a <strong>right</strong>s-based<br />

approach is that it requires a high degree of effective participation of partners <strong>in</strong> <strong>and</strong> beneficiaries of programmes.<br />

Fur<strong>the</strong>rmore, translat<strong>in</strong>g people’s <strong>water</strong> needs <strong>in</strong><strong>to</strong> <strong>right</strong>s <strong>in</strong>volves reforms <strong>in</strong> law, policies <strong>and</strong><br />

practices <strong>and</strong> prepares for <strong>the</strong> transition from <strong>emergency</strong> <strong>to</strong> development by focus<strong>in</strong>g on long-term <strong>and</strong><br />

susta<strong>in</strong>able change.<br />

Unlike needs, <strong>right</strong>s are accompanied by correspond<strong>in</strong>g duties <strong>to</strong> act. States, as <strong>the</strong> first duty-bearers <strong>in</strong><br />

terms of <strong>human</strong> <strong>right</strong>s, have a broad range of <strong>water</strong> <strong>and</strong> <strong>sanitation</strong> related obligations. As previously mentioned,<br />

<strong>the</strong>y are required <strong>to</strong> call for assistance from <strong>the</strong> <strong>in</strong>ternational community if <strong>the</strong>y are unable <strong>to</strong> fulfil<br />

<strong>the</strong>ir obligations. In <strong>the</strong> same way, <strong>the</strong> <strong>in</strong>ternational community has a duty <strong>to</strong> respond <strong>to</strong> a state’s call for<br />

assistance, which would <strong>the</strong>n clearly show <strong>the</strong> l<strong>in</strong>k <strong>to</strong> advocacy. In so do<strong>in</strong>g, this approach also provides<br />

a valid basis upon which <strong>to</strong> hold all relevant ac<strong>to</strong>rs accountable, especially States. National mechanisms,<br />
