addition, States that have withdrawn fund<strong>in</strong>g for <strong>water</strong> <strong>and</strong> <strong>sanitation</strong> services <strong>in</strong> Gaza have underm<strong>in</strong>ed<br />

<strong>the</strong> ICESCR which requires all States <strong>to</strong> engage <strong>in</strong> <strong>in</strong>ternational assistance <strong>and</strong> cooperation<br />

for <strong>the</strong> realization of economic, social <strong>and</strong> cultural <strong>right</strong>s. Any measure which causes retrogression<br />

<strong>in</strong> <strong>the</strong> realization of <strong>the</strong> <strong>right</strong> <strong>to</strong> <strong>water</strong> <strong>and</strong> <strong>sanitation</strong> is a clear violation of <strong>the</strong> ICESCR.<br />

- Fur<strong>the</strong>r, as an occupy<strong>in</strong>g power, Israel is obliged <strong>to</strong> comply with International Humanitarian Law,<br />

<strong>in</strong>clud<strong>in</strong>g <strong>the</strong> Fourth Geneva Convention relative <strong>to</strong> <strong>the</strong> Protection of Civilian Persons <strong>in</strong> Time of<br />

War <strong>and</strong> cus<strong>to</strong>mary <strong>in</strong>ternational law. In particular, Israel must ensure that civilians are guaranteed<br />

access <strong>to</strong> dr<strong>in</strong>k<strong>in</strong>g <strong>water</strong>, <strong>water</strong> for personal hygiene <strong>and</strong> <strong>sanitation</strong>; ensure that public health <strong>and</strong><br />

hygiene is ma<strong>in</strong>ta<strong>in</strong>ed <strong>in</strong> <strong>the</strong> occupied terri<strong>to</strong>ry; comply with <strong>the</strong> prohibition on attacks <strong>to</strong> civilian<br />

<strong>in</strong>frastructure, <strong>in</strong>clud<strong>in</strong>g dr<strong>in</strong>k<strong>in</strong>g <strong>water</strong> <strong>in</strong>stillations; respect <strong>the</strong> pr<strong>in</strong>ciple of proportionality which<br />

requires that any reaction <strong>to</strong> an attack is not excessive by caus<strong>in</strong>g harm <strong>to</strong> civilians or civilian property<br />

which outweighs <strong>the</strong> expected military advantage; refra<strong>in</strong> from punish<strong>in</strong>g persons for offences<br />

that <strong>the</strong>y have not personally committed; <strong>and</strong>, permit <strong>and</strong> facilitate <strong>the</strong> delivery <strong>human</strong>itarian<br />

relief <strong>to</strong> <strong>the</strong> occupied terri<strong>to</strong>ry.<br />

Advocacy <strong>in</strong>itiatives:<br />

- On 28 Oc<strong>to</strong>ber 2007, ten Israeli <strong>and</strong> Palest<strong>in</strong>ian <strong>human</strong> <strong>right</strong>s organizations petitioned <strong>the</strong> Israeli<br />

Supreme Court, seek<strong>in</strong>g an <strong>in</strong>junction aga<strong>in</strong>st fuel <strong>and</strong> electricity sanctions. The petitioners argued<br />

that <strong>the</strong> reduction of fuel <strong>and</strong> electricity supplies would cause widespread damage <strong>to</strong> essential<br />

services <strong>in</strong> Gaza <strong>in</strong>clud<strong>in</strong>g health systems, <strong>water</strong> wells <strong>and</strong> sewage treatment facilities. Moreover,<br />

<strong>the</strong>y stated that <strong>the</strong> disruptions caused <strong>to</strong> <strong>the</strong> supply of essential goods <strong>and</strong> services amounts<br />

<strong>to</strong> <strong>the</strong> collective punishment of <strong>the</strong> civilian population, s<strong>in</strong>ce Israel is prevent<strong>in</strong>g <strong>the</strong> people of<br />

Gaza from obta<strong>in</strong><strong>in</strong>g <strong>the</strong>se goods <strong>and</strong> services from an alternative source. In its f<strong>in</strong>al rul<strong>in</strong>g on 30<br />

January 2008, <strong>the</strong> Supreme Court rejected <strong>the</strong> petition <strong>and</strong> upheld <strong>the</strong> Government of Israel’s<br />

decision <strong>to</strong> reduce fuel <strong>and</strong> electricity supplies <strong>to</strong> Gaza. The Supreme Court erroneously argued<br />

that as Israel’s occupation of Gaza had come <strong>to</strong> an end Israel holds no obligations under International<br />

Humanitarian Law <strong>to</strong>wards Gaza’s population. This goes aga<strong>in</strong>st <strong>the</strong> widely held view that as<br />

Israel ma<strong>in</strong>ta<strong>in</strong>s «effective control» over Gaza it cont<strong>in</strong>ues <strong>to</strong> hold legal responsibility <strong>to</strong> ensure <strong>the</strong><br />

welfare of Gaza’s civilian population. Numerous United Nations Treaty Bodies <strong>and</strong> <strong>the</strong> International<br />

Court of Justice have asserted that Israel is bound by <strong>the</strong> provisions of both International Human<br />

Rights Law <strong>and</strong> International Humanitarian Law <strong>in</strong> <strong>the</strong> Occupied Terri<strong>to</strong>ries.<br />

- As efforts <strong>to</strong> hold Israel responsible for violations of <strong>human</strong> <strong>right</strong>s law <strong>and</strong> <strong>human</strong>itarian law <strong>in</strong><br />

Gaza have largely failed, an <strong>in</strong>creas<strong>in</strong>g number of <strong>human</strong> <strong>right</strong>s <strong>and</strong> <strong>human</strong>itarian organizations<br />

have been plac<strong>in</strong>g pressure on o<strong>the</strong>r ac<strong>to</strong>rs <strong>in</strong>clud<strong>in</strong>g <strong>the</strong> European Union <strong>to</strong> address <strong>the</strong> deteriorat<strong>in</strong>g<br />

situation <strong>in</strong> <strong>the</strong> Gaza Strip. On 11 June 2008, eighteen organizations signed a letter call<strong>in</strong>g<br />

upon <strong>the</strong> European Union <strong>to</strong> place <strong>human</strong> <strong>right</strong>s conditionalities on Israel with<strong>in</strong> <strong>the</strong> framework<br />

of <strong>the</strong> EU-Israel Association Agreement <strong>in</strong>clud<strong>in</strong>g <strong>to</strong> ensure that Israel ends <strong>the</strong> blockade on <strong>the</strong><br />

Gaza Strip which has underm<strong>in</strong>ed <strong>the</strong> economic <strong>and</strong> social <strong>right</strong>s of Gazans. Fur<strong>the</strong>r, <strong>the</strong> organizations<br />

called upon <strong>the</strong> EU <strong>to</strong> access <strong>the</strong> extent <strong>to</strong> which its own external actions breached<br />

fundamental pr<strong>in</strong>ciples of <strong>the</strong> European Union, <strong>in</strong>clud<strong>in</strong>g a respect for <strong>human</strong> <strong>right</strong>s.<br />
