- Part 2 - Def<strong>in</strong>ition of <strong>the</strong> <strong>right</strong> <strong>to</strong> <strong>water</strong> <strong>and</strong> <strong>sanitation</strong> <strong>in</strong> <strong>emergency</strong> <strong>situations</strong><br />

- Accord<strong>in</strong>g <strong>to</strong> <strong>the</strong> ICC Statute, <strong>the</strong> use of starvation as a method of warfare is a war crime when committed<br />

<strong>in</strong> <strong>in</strong>ternational armed conflicts 89 . Even though <strong>the</strong> provision does not explicitly refer <strong>to</strong> <strong>water</strong>,<br />

this natural resource is clearly among <strong>the</strong> objects deemed <strong>in</strong>dispensable <strong>to</strong> survival. It should be noted<br />

that no similar provision exists for non-<strong>in</strong>ternational armed conflicts. However, <strong>in</strong> case of non-<strong>in</strong>ternational<br />

armed conflict, “it may be argued that this act does constitute a war crime under cus<strong>to</strong>mary<br />

<strong>in</strong>ternational law”. 90<br />

- In addition, under <strong>the</strong> ICC Statute, “Intentionally direct<strong>in</strong>g attacks aga<strong>in</strong>st civilian objects, that is,<br />

objects which are not military objectives” 91 is a war crime when committed <strong>in</strong> <strong>in</strong>ternational armed<br />

conflicts. In non-<strong>in</strong>ternational armed conflict, it is a war crime <strong>to</strong> “destroy <strong>the</strong> property of an adversary<br />

unless such destruction be imperatively dem<strong>and</strong>ed by <strong>the</strong> necessities of <strong>the</strong> conflict”. This would<br />

clearly apply <strong>to</strong> <strong>the</strong> destruction of <strong>water</strong> <strong>in</strong>stallations.<br />

- F<strong>in</strong>ally, <strong>the</strong> ICC considers that: “widespread, long-term <strong>and</strong> severe damage <strong>to</strong> <strong>the</strong> natural environment<br />

which would be clearly excessive <strong>in</strong> relation <strong>to</strong> <strong>the</strong> concrete <strong>and</strong> direct overall military advantage<br />

anticipated” 92 constitutes a war crime <strong>in</strong> <strong>in</strong>ternational armed conflicts.<br />

In light of this, <strong>and</strong> tak<strong>in</strong>g <strong>in</strong><strong>to</strong> account <strong>the</strong> responsibility <strong>to</strong> protect 93 populations from genocide,<br />

war crimes <strong>and</strong> crimes aga<strong>in</strong>st <strong>human</strong>ity which lies with States <strong>and</strong> <strong>the</strong> <strong>in</strong>ternational community,<br />

<strong>in</strong> our work:<br />

- We can stress that <strong>water</strong> <strong>and</strong> <strong>sanitation</strong> crimes can be considered as <strong>in</strong>ternational crimes.<br />

Indeed, <strong>water</strong>-related abuses provide key opportunities for field-based advocacy l<strong>in</strong>ked <strong>to</strong> <strong>in</strong>ternational<br />

messag<strong>in</strong>g (e.g. with States, <strong>the</strong> Security Council, Human Rights Council, IASC, <strong>and</strong> with<br />

alliances with <strong>human</strong>itarian <strong>and</strong> <strong>human</strong> <strong>right</strong>s NGOs, UN agencies <strong>and</strong> Red Cross <strong>and</strong> Red Crescent<br />

Movement). The expertise <strong>and</strong> experience of <strong>human</strong>itarian agencies <strong>in</strong> <strong>the</strong> <strong>water</strong>, <strong>sanitation</strong><br />

<strong>and</strong> hygiene sec<strong>to</strong>r on <strong>the</strong> ground is a critical strength <strong>in</strong> our reports <strong>and</strong> <strong>in</strong> our advocacy work<br />

dur<strong>in</strong>g <strong>in</strong>ternational forums. We must capitalize upon that expertise <strong>and</strong> knowledge.<br />

- We can lobby governments <strong>to</strong> support <strong>the</strong> International Crim<strong>in</strong>al Court as this organization only<br />

recently began its work (2002).<br />

- We can raise awareness among all ac<strong>to</strong>rs deal<strong>in</strong>g with armed conflicts, from States parties <strong>and</strong><br />

armed groups <strong>to</strong> NGOs <strong>and</strong> aid agencies by dissem<strong>in</strong>at<strong>in</strong>g relevant <strong>in</strong>formation on exist<strong>in</strong>g legal<br />

provisions that protect <strong>water</strong> <strong>and</strong> <strong>water</strong> facilities dur<strong>in</strong>g armed conflicts.<br />
