10.5. Conclusion<br />

International Humanitarian Law conta<strong>in</strong>s rules aimed at ensur<strong>in</strong>g that populations caught up <strong>in</strong> armed<br />

conflict have access <strong>to</strong> fresh <strong>water</strong>. However, contrary <strong>to</strong> <strong>human</strong> <strong>right</strong>s treaties, IHL does not bes<strong>to</strong>w<br />

«subjective» <strong>right</strong>s on <strong>in</strong>dividuals. Instead it sets out obligations <strong>in</strong>cumbent upon parties <strong>to</strong> <strong>the</strong> conflict.<br />

F<strong>in</strong>ally, if IHL does not specifically mention «<strong>the</strong> <strong>right</strong> <strong>to</strong> <strong>water</strong> <strong>and</strong> <strong>sanitation</strong>» as we underst<strong>and</strong> it here, it is,<br />

<strong>in</strong> reality, this basic <strong>right</strong> that is <strong>to</strong> be protected. In no way should <strong>the</strong> fact that it is not explicitly mentioned<br />

be taken <strong>to</strong> imply that this <strong>right</strong> does not exist under IHL - quite <strong>the</strong> contrary. Fur<strong>the</strong>rmore, <strong>the</strong> follow<strong>in</strong>g<br />

chapter shows that, henceforth, war crimes that relate <strong>to</strong> <strong>water</strong> <strong>and</strong> <strong>water</strong> facilities can be judged before<br />

<strong>the</strong> International Crim<strong>in</strong>al Court.<br />

In our work we should remember that:<br />

In addition <strong>to</strong> <strong>the</strong> «remedial actions» that <strong>human</strong>itarian aid agencies <strong>and</strong> personnel must undertake<br />

<strong>in</strong> time of war <strong>and</strong> armed conflict, for <strong>in</strong>stance, facilitat<strong>in</strong>g access <strong>to</strong> dr<strong>in</strong>k<strong>in</strong>g <strong>water</strong>, <strong>water</strong><br />

distribution (with tanker trucks, etc.), repair<strong>in</strong>g supply systems, seek<strong>in</strong>g <strong>to</strong> purify dr<strong>in</strong>k<strong>in</strong>g <strong>water</strong><br />

<strong>and</strong> dr<strong>in</strong>k<strong>in</strong>g <strong>water</strong> service providers, it is also our responsibility <strong>to</strong> take a number of «preventive<br />

measures», for example, <strong>in</strong>ter alia:<br />

- Expla<strong>in</strong> <strong>and</strong> pass on <strong>to</strong> <strong>the</strong> <strong>human</strong>itarian community, decision-makers <strong>and</strong> <strong>the</strong> general public as<br />

much <strong>in</strong>formation as possible about <strong>the</strong> <strong>in</strong>ternational rules protect<strong>in</strong>g <strong>water</strong> supplies <strong>and</strong> access<br />

<strong>to</strong> <strong>water</strong> for civilians. This can help <strong>in</strong> efforts <strong>to</strong> provide better protection (material <strong>and</strong> legal) for<br />

<strong>water</strong> supply systems;<br />

- Improve coord<strong>in</strong>ation <strong>and</strong> cooperation <strong>in</strong> <strong>the</strong> exchange of appropriate <strong>in</strong>formation, knowledge<br />

<strong>and</strong> expertise <strong>in</strong> this doma<strong>in</strong> between all stakeholders <strong>in</strong>volved;<br />

- Call on all parties <strong>to</strong> a conflict <strong>to</strong> absta<strong>in</strong> from attack<strong>in</strong>g <strong>water</strong> treatment facilities <strong>and</strong> distribution<br />

systems for civilian use <strong>and</strong> <strong>the</strong> staff employed <strong>to</strong> repair <strong>and</strong> ma<strong>in</strong>ta<strong>in</strong> <strong>the</strong>m.<br />
