should prioritize <strong>the</strong>se personal <strong>and</strong> domestic uses over o<strong>the</strong>r <strong>water</strong> uses <strong>and</strong> should<br />

take steps <strong>to</strong> ensure that this sufficient amount is of good quality, affordable for all <strong>and</strong><br />

can be collected with<strong>in</strong> a reasonable distance from a person’s home.<br />

67. The High Commissioner notes that <strong>the</strong>re is a need for fur<strong>the</strong>r elaboration of certa<strong>in</strong><br />

aspects of <strong>human</strong> <strong>right</strong>s obligations attached <strong>to</strong> access <strong>to</strong> safe dr<strong>in</strong>k<strong>in</strong>g <strong>water</strong> <strong>and</strong> <strong>sanitation</strong>.<br />

Exist<strong>in</strong>g <strong>human</strong> <strong>right</strong>s <strong>in</strong>struments have provided <strong>the</strong> basis for expert <strong>human</strong> <strong>right</strong>s bodies<br />

<strong>to</strong> elaborate on States’ obligations, but <strong>the</strong> study has highlighted <strong>the</strong> fact that detailed practical<br />

advice is required on <strong>the</strong> follow<strong>in</strong>g issues: <strong>the</strong> normative content of <strong>human</strong> <strong>right</strong>s obligations <strong>in</strong><br />

relation <strong>to</strong> access <strong>to</strong> <strong>sanitation</strong>; <strong>the</strong> <strong>human</strong> <strong>right</strong>s obligations attached <strong>to</strong> <strong>the</strong> elaboration of a national<br />

strategy on <strong>water</strong> <strong>and</strong> <strong>sanitation</strong>; <strong>the</strong> regulation of <strong>the</strong> private sec<strong>to</strong>r <strong>in</strong> <strong>the</strong> context of private<br />

provision of safe dr<strong>in</strong>k<strong>in</strong>g <strong>water</strong> <strong>and</strong> <strong>sanitation</strong>; criteria <strong>to</strong> protect <strong>the</strong> <strong>right</strong> <strong>to</strong> safe dr<strong>in</strong>k<strong>in</strong>g <strong>water</strong><br />

<strong>and</strong> <strong>sanitation</strong> <strong>in</strong> case of disconnection; <strong>and</strong> <strong>the</strong> specific obligations of local authorities.<br />

68. A number of questions require fur<strong>the</strong>r debate: whe<strong>the</strong>r access <strong>to</strong> safe dr<strong>in</strong>k<strong>in</strong>g <strong>water</strong> <strong>and</strong> <strong>sanitation</strong><br />

is a self-st<strong>and</strong><strong>in</strong>g <strong>right</strong> or is derived from o<strong>the</strong>r <strong>human</strong> <strong>right</strong>s; prioritization among various<br />

<strong>water</strong> uses; <strong>in</strong>teraction with o<strong>the</strong>r areas of <strong>in</strong>ternational law, <strong>in</strong>clud<strong>in</strong>g trade <strong>and</strong> <strong>in</strong>vestment law.<br />

69. Although various mechanisms at <strong>the</strong> <strong>in</strong>ternational, regional <strong>and</strong> national level moni<strong>to</strong>r certa<strong>in</strong><br />

aspects <strong>and</strong> dimensions of <strong>human</strong> <strong>right</strong>s obligations <strong>in</strong> relation <strong>to</strong> access <strong>to</strong> safe dr<strong>in</strong>k<strong>in</strong>g <strong>water</strong><br />

<strong>and</strong> <strong>sanitation</strong>, <strong>the</strong> overall issue is currently be<strong>in</strong>g neglected. While United Nations special procedures<br />

<strong>and</strong> treaty bodies have contributed <strong>to</strong> clarify<strong>in</strong>g <strong>human</strong> <strong>right</strong>s obligations <strong>in</strong> relation <strong>to</strong><br />

access <strong>to</strong> safe dr<strong>in</strong>k<strong>in</strong>g <strong>water</strong> <strong>and</strong> <strong>sanitation</strong>, <strong>the</strong>ir work also highlights <strong>the</strong> difficult task of cover<strong>in</strong>g<br />

<strong>the</strong>se issues <strong>in</strong> a comprehensive <strong>and</strong> cont<strong>in</strong>uous way. Specific, dedicated <strong>and</strong> susta<strong>in</strong>ed attention<br />

<strong>to</strong> safe dr<strong>in</strong>k<strong>in</strong>g <strong>water</strong> <strong>and</strong> <strong>sanitation</strong> is lack<strong>in</strong>g at <strong>the</strong> <strong>in</strong>ternational level, given <strong>the</strong> broad range of<br />

issues that special procedures <strong>and</strong> treaty bodies have <strong>to</strong> address with<strong>in</strong> <strong>the</strong>ir m<strong>and</strong>ate <strong>and</strong> <strong>the</strong><br />

specific questions that arise <strong>in</strong> relation <strong>to</strong> access <strong>to</strong> safe dr<strong>in</strong>k<strong>in</strong>g <strong>water</strong> <strong>and</strong> <strong>sanitation</strong>.<br />

70. To this end, <strong>the</strong> High Commissioner:<br />

(a) Encourages <strong>the</strong> Human Rights Council <strong>to</strong> cont<strong>in</strong>ue its consideration of <strong>human</strong> <strong>right</strong>s obligations<br />

<strong>in</strong> relation <strong>to</strong> access <strong>to</strong> safe dr<strong>in</strong>k<strong>in</strong>g <strong>water</strong> <strong>and</strong> <strong>sanitation</strong> as set out above;<br />

(b) Encourages States, <strong>in</strong>tergovernmental organizations, national <strong>human</strong> <strong>right</strong>s <strong>in</strong>stitutions, civil<br />

society <strong>and</strong> bus<strong>in</strong>ess enterprises <strong>to</strong> identify good practices <strong>in</strong> <strong>the</strong> field of safe dr<strong>in</strong>k<strong>in</strong>g <strong>water</strong>,<br />

<strong>sanitation</strong> <strong>and</strong> <strong>human</strong> <strong>right</strong>s <strong>and</strong> make <strong>the</strong>m available <strong>to</strong> <strong>the</strong> OHCHR.<br />

As <strong>the</strong> pr<strong>in</strong>cipal United Nations body responsible for <strong>human</strong> <strong>right</strong>s, <strong>the</strong> steps taken by <strong>the</strong> Human Rights<br />

Council <strong>to</strong>wards recognition of <strong>the</strong> <strong>right</strong> <strong>to</strong> <strong>water</strong> <strong>and</strong> <strong>sanitation</strong> are positive developments. At its March<br />

2008 session, <strong>the</strong> Human Rights Council adopted without a vote a resolution (A/HRC/7/22) 71 , which made<br />

an important legal statement: “Emphasiz<strong>in</strong>g that <strong>in</strong>ternational <strong>human</strong> <strong>right</strong>s law <strong>in</strong>struments, <strong>in</strong>clud<strong>in</strong>g <strong>the</strong><br />

Covenant on Economic, Social <strong>and</strong> Cultural Rights, <strong>the</strong> International Convention on <strong>the</strong> Elim<strong>in</strong>ation of All<br />

Forms of Discrim<strong>in</strong>ation aga<strong>in</strong>st Women <strong>and</strong> <strong>the</strong> Convention on <strong>the</strong> Right of <strong>the</strong> Child, entail obligations <strong>in</strong><br />

relation <strong>to</strong> access <strong>to</strong> safe dr<strong>in</strong>k<strong>in</strong>g <strong>water</strong> <strong>and</strong> <strong>sanitation</strong>.” The resolution also established <strong>the</strong> m<strong>and</strong>ate of an<br />

<strong>in</strong>dependent expert on <strong>the</strong> issue of <strong>human</strong> <strong>right</strong>s obligations related <strong>to</strong> safe dr<strong>in</strong>k<strong>in</strong>g <strong>water</strong> <strong>and</strong> <strong>sanitation</strong>.<br />

At its September 2008 session, <strong>the</strong> Human Rights Council decided <strong>to</strong> appo<strong>in</strong>t Ms. Catar<strong>in</strong>a de Albuquerque<br />

as <strong>the</strong> <strong>in</strong>dependent expert. She <strong>to</strong>ok up her m<strong>and</strong>ate on 1 November 2008, <strong>the</strong> terms of which are<br />

set out <strong>in</strong> Box 14. Ms. de Albuquerque will present her first prelim<strong>in</strong>ary report <strong>to</strong> <strong>the</strong> Council <strong>in</strong> March 2009<br />

<strong>and</strong> annual reports <strong>the</strong>reafter.<br />
