Accessibility32 The Comment stipulates that <strong>water</strong> <strong>and</strong> <strong>water</strong> facilities <strong>and</strong> services must be<br />

accessible <strong>to</strong> everyone, without discrim<strong>in</strong>ation, with<strong>in</strong> <strong>the</strong> jurisdiction of <strong>the</strong> State<br />

Party. Two parameters def<strong>in</strong>e accessibility: those of a physical <strong>and</strong> those of<br />

an economic nature.<br />

a) Water sources must be available with<strong>in</strong> safe physical reach for everyone,<br />

without discrim<strong>in</strong>ation. Water sources must be available <strong>in</strong> <strong>the</strong> vic<strong>in</strong>ity of each<br />

household, workplace <strong>and</strong> educational <strong>in</strong>stitution <strong>and</strong> respect traditions, culture,<br />

privacy <strong>and</strong> gender requirements of populations concerned.<br />

b) Whilst GC 15 does not fix a price for <strong>water</strong> it stresses <strong>the</strong> pr<strong>in</strong>ciples of equity<br />

<strong>and</strong> f<strong>in</strong>ancial accessibility, or affordability: everyone, even <strong>the</strong> poorest, should<br />

be able <strong>to</strong> have access <strong>to</strong> <strong>water</strong> <strong>and</strong> <strong>sanitation</strong>.<br />

As outl<strong>in</strong>ed <strong>in</strong> GC 15, <strong>the</strong> follow<strong>in</strong>g aspects are also important components of <strong>the</strong> <strong>human</strong> <strong>right</strong> <strong>to</strong> <strong>water</strong>.<br />

groups that have traditionally experienced discrim<strong>in</strong>ation<br />

Access <strong>to</strong> <strong>in</strong>formation<br />

<strong>and</strong> participation 34<br />

GC 15 def<strong>in</strong>es <strong>the</strong> <strong>right</strong> <strong>to</strong> <strong>water</strong> as a <strong>right</strong> that <strong>in</strong>cludes “<strong>the</strong> <strong>right</strong> <strong>to</strong> seek,<br />

receive <strong>and</strong> impart <strong>in</strong>formation concern<strong>in</strong>g <strong>water</strong> issues”.<br />

Accountability 35 Accord<strong>in</strong>g <strong>to</strong> GC 15, any persons or groups denied of <strong>the</strong>ir <strong>right</strong> <strong>to</strong> <strong>water</strong><br />

should have access <strong>to</strong> effective judicial or o<strong>the</strong>r appropriate remedies, for<br />

example, national ombudsmen or <strong>human</strong> <strong>right</strong>s commissions.<br />
