Comunicazione telematica delle<br />
operazioni rilevanti ai fini<br />
dell’imposta sul valore aggiunto,<br />
di importo non inferiore a<br />
tremila Euro<br />

L’articolo 21, Decreto Legge 31 maggio 2010, n. 78 (“manovra<br />
correttiva 2010”), convertito con modificazioni<br />
dalla Legge 30 luglio 2010, n. 122, ha introdotto, all’articolo<br />
21, l’obbligo di comunicare, per via esclusivamente<br />
telematica, le operazioni rilevanti ai fini IVA di importo<br />
non inferiore a 3.000 euro.<br />
Tale norma ha demandato a un provvedimento del Direttore<br />
dell’Agenzia delle Entrate, le modalità attuative ed i<br />
termini del nuovo obbligo comunicativo.<br />
La relazione accompagnatoria del Decreto Legge, illustra<br />
come i nuovi dati raccolti debbano essere utilizzati per<br />
“l'individuazione di spese e consumi di particolare rilevanza<br />
utili alla individuazione di capacità contributiva”,<br />
nonché per la ricostruzione della congruità dei volumi<br />
d'affari e dei costi indicati nelle dichiarazioni.<br />
L'insieme dei dati acquisiti (ad esempio, vendita di<br />
gioielli o consulenze di particolare rilievo) serviranno sia<br />
(i) ad aumentare l'attendibilità degli accertamenti basati<br />
sul nuovo “redditometro ” sia (ii) a contrastare le frodi<br />
IVA e i fenomeni di elusione, assicurando una più precisa<br />
mappatura dei trasferimenti di denaro.<br />
Il Direttore dell’Agenzia delle Entrate, con provvedimento<br />
del 22 dicembre 2010, ha dato attuazione alla<br />
disciplina introdotta dall’articolo 21, D.L. n. 78/2010,<br />
approvando contestualmente le specifiche tecniche per<br />
la trasmissione telematica (unica modalità prevista per<br />
adempiere l’obbligo comunicativo in commento).<br />
Il provvedimento, oltre ad indicare gli obbligati agli<br />
adempimenti comunicativi (tutti i soggetti passivi IVA<br />
che effettuano operazioni rilevanti ai fini di tale imposta),<br />
al paragrafo 2, pone una prima distinzione tra:<br />
- le operazioni soggette a fatturazione, per le quali il limite<br />
di 3.000 euro va calcolato al netto dell’IVA, e<br />
- le operazioni (sempre rilevanti ai fini IVA) per cui non<br />
sia obbligatoria l’emissione della fattura, per le quali il<br />
limite è stabilito in 3.600 euro al lordo dell’IVA applicata.<br />
Il provvedimento pone regole particolari per i contratti di<br />
appalto, fornitura, somministrazione e, più in generale,<br />
per i contratti dai quali derivino corrispettivi periodici,<br />
per i quali gli obblighi di comunicazione all’Agenzia delle<br />
Entrate sussistono solo se il limite di 3.000 euro viene<br />
superato con riferimento all’intero anno solare.<br />

Article 21 of the Law Decree no. 78, issued on 31st May<br />
2010 (“corrective manoeuvre 2010”), converted with<br />
amendment of the Law dated 30th July 2010, no. 122, has<br />
introduced, in article 21, the obligation to communicate,<br />
exclusively in a telematic way, relevant operations for VAT<br />
purposes for an amount non inferior to 3.000 Euros.<br />
Such rule referred the instructions and terms of the new<br />
obligation to communicate, to a decision to be issued by<br />
the Tax Authorities’ Director.<br />
The accompanying statement of the Law Decree explains<br />
how the new data collected must be used for “the identification<br />
of expenses and consumptions, particularly useful<br />
to the identification of contributive capacity”, as well as<br />
for the reconstruction of the congruity of turnovers and<br />
costs indicated in the declarations.<br />
All collected data (for example, the sale of jewels or particularly<br />
relevant advice) will be useful to (i) increase the<br />
reliability of the assessments based on the new “income<br />
assessment system”, or (ii) to contrast VAT fraud and<br />
phenomena of tax avoidance, by assuring a more precise<br />
mapping of money transfers.<br />
The Italian Revenue Agency’s Director, with the decision<br />
dated 22nd December 2010, put into effect the legislation<br />
introduced by article 21, L.D. no. 78/2010, approving contextually<br />
the specific techniques for the telematic transmissions<br />
(the only modality provided to fulfill the obligation<br />
at issue).<br />
As well as identifying the entities subject to the obligation<br />
(all VAT taxable entities that carry out operations for such<br />
tax purposes), at paragraph 2 the decision lays down a<br />
first distinction between:<br />
- operations subject to invoicing, for which the limit of<br />
3.000 Euros is to be calculated net of VAT, and<br />
- operations (relevant for VAT purposes) in which the<br />
invoice issuing is not mandatory, and for which the limit is<br />
established at 3.600 Euros before-tax.<br />
The decision points out particular rules for contract works,<br />
supplying contracts and generally, for those contracts<br />
with periodical compensations, in which the obligation to<br />
communicate to the Tax Authorities subsists only where<br />
the limit of 3.000 Euros is exceeded with reference to the<br />
whole calendar year.<br />
