The new provisions will apply from the tax period in
progress at the date of entry into force of the law of conversion
of the decree Milleproroghe: please note that also
entities not affected by the new rules may in be required to
re-determine the amount prepayments for FY 2011 in case
a goodwill realigned pursuant to article 15, Legislative Decree
n. 185/08, has been deducted in 2010 for an amount
equal to one-ninth of their amount.
By decree of non-regulatory, the Minister of Economy and
Finance, in consultation with the Bank of Italy, may establish
implementation rules.
Finally, it should be note that the conversion of tax assets in
tax credits was introduced in the light of the forthcoming
entry into force of the new Basel Accord 3. The purpose of
the rule, rather than tax incentives, it seems more related
to promote the capitalization of Italian banks. In fact, as
reported in specialized press, this benefit should also be
granted to banks in profits, since the clause converting deferred
tax assets in the tax credit would reduce the negative
impacts of deferred tax assets on core tier 1 capital (common
or equity) in compliance with the new Basel 3.
