comunicativi entreranno a regime dall’1 maggio 2011.
comunicazione; infatti, limitatamente all’anno 2010
all’obbligo di fatturazione.
In particolare, è
continuata (appalti, forniture, somministrazioni, etc.)
pertanto, considerare i prezzi o compensi pattuiti durante
tutto il periodo d’imposta.
Moreover, the decision has defined that the obligation to
communicate will come into effect as from 1st May 2011.
On the contrary, for year 2010 and for the first four
months of 2011, a gradual approach to the obligation to
communicate has been adopted; as a matter of fact, as far
as year 2010 is concerned, paragraph 2.3 of the decision
provides that (i) the threshold of 3.000 Euros will be
increased to 25.000 Euros and (ii) the communication
should be limited to operations subject to the obligation of
invoicing.
During the period in course between 1st January and 30th
April 2011, the threshold in force is 3.000 Euros, provided
for by Law Decree no. 78/2010, it being understood that
operations non subject to mandatory invoicing will continue
to be excluded from the obligation to communicate;
therefore, operations for which it is mandatory the issuing
of a receipt for fiscal purposes or a ticket, or operations
made towards final consumers, should not be subject to the
communication.
As from 1st May 2011 the instruction will be fully put into
effect, with obligations extended also to operations non
subject to invoicing, it being understood that the threshold
will be 3.000 Euros for operations subject to invoicing, and
3.600 Euros (inclusive of tax) for operations non subject
to such fulfillment.
Therefore, as from 1st May 2011, operators will have to
take note of the fiscal code of their private clients that will
make operations of value superior to 3.600 Euros (inclusive
of VAT, independently from the applied tax rate).
Also, regarding the deadlines, the decision will be introduced
gradually.
Notwithstanding the fact that the ordinary deadline is
fixed at 30th April of the year following the one it refers to,
for year 2010 only the communication deadline is fixed at
31st October 2011.
As it has already been provided for similar obligations, a
possibility is allowed to send a substitutive communication
of the one already transmitted, in order to correct possible
errors or omissions, with the condition that the sending
occurs within 30 days following the term provided for the
transmission of the original communication.
The Tax Authorities, during the “Telefisco” 2011, provided
the first informal interpretative clarifications regarding
the new regulation. In particular, the non-formalization
of the agreed contract between the seller and the buyer, regarding
operations with continuous execution (contracts,
supplies, etc.) has not to be taken into consideration for
the communication purposes and therefore prices or
payments agreed during the tax year are to be considered.
