è iscritto nell’archivio informatico (cosiddetto: silenzio
assenso).
presentata a mano o tramite raccomandata presso qualsiasi
ufficio territoriale;
possono presentare, esclusivamente all’ufficio a cui è
intracomunitarie, verranno inseriti automaticamente
Within 30 days from the receipt of the above declaration of
intention, the Italian Revenue Agency verifies the provided
information and makes a preliminary assessment of
the risk of the subject, issuing a refusal in case of negative
evaluations.
At the contrary, if after the above mentioned 30 days Tax
Administration has not objected in writing, the tax payers
is included in the archive (so-called: silent consent).
In any case, the Italian Revenue Agency is allowed to carry
out more extensive checks on the taxpayer within six
months by the receiving the declaration of intent.
VAT tax payers are in any time allowed to communicate
their intention to back the option to carry out intra-community
transactions and, therefore, to be excluded from the
archive.
As at today Italian Revenue Agency does not currently provide
official explanations, but two press releases of 26 and
27 January, stated as follows:
• only taxpayers who wish to perform intra-community
transactions must submit the application to declare
their intention to work with foreign countries; the application
may be submitted either by hand or by registered post
office to any territorial office;
• taxpayers who presented an unjustified request,
that is unrelated to the real intention or need to carry out
intra-community transactions, may submit to the competent
local tax office a new instance in order to be excluded
by the archive. In fact, it has to be underlined that the
inclusion in VIES involves the tax payers’ position will be
scrutinized by Italian Revenue Agency.
The final version of the new VIES is available starting from
March, because by February 28, 2011 the Tax Authorities
will have deleted the unauthorized tax payers.
Moreover, starting from February 1st, on the website of the
Italian Revenue Agency has been activated a service that
allows to see the list of VAT tax payers that will be automatically
included in the new VIES, as they already meet the
specific requirements.
Operators who are not present in the VIES, having already
filed in the specific request, must wait until the end of
February in order to verify their inclusion.
