Archivio VIES: nuove procedure
autorizzative
(Leonardo Penna – Manuela Sorbara)
articolo 35, DPR n. 633/1972, i soggetti intenzionati
individuare i seguenti scenari:
presentazione degli elenchi INTRASTAT;
Archive VIES: news rules for the
inclusion
(Leonardo Penna – Manuela Sorbara)
With the issuing of the measures No. 2010/188381 and
No. 2010/188376 dated December 29, 2010 by the Italian
Revenue Agency, the new authorization regime for carrying
out intra-community transactions has been introduced as
part of measures to combat VAT fraud, according to article
27 of Decree 78/2010, converted into the law n. 122 dated
July 30, 2010.
Starting from May 31, 2010, according to the new article
35 of Presidential Decree no. 633/1972, tax payers who
wish to make intra-community transactions must be, therefore,
authorized by the Italian Revenue Agency.
With the above mentioned measures, Italian Revenue
Agency defined criteria and procedures for inclusion of
Italian VAT numbers in the archive of subject authorized
to carry out intra-community transactions (VIES) and the
procedures of denial and revocation of the authorization.
According to the above mentioned measures, it is possible to
identify the following scenarios:
a) VAT tax payers who submitted the declaration of beginning
of their business activity between May 31, 2010 and
February 28, 2011, at this latter date will be excluded from
the archive VIES, if :
- they have not expressed their will to carry out intra-community
transactions when the appropriate model has been
filled in, and
- they have not carry out in the second half of 2010 intracommunity
transactions and submitted the relevant
INTRASTAT forms;
b) VAT tax payers who submitted the declaration of beginning
of their business before May 31, 2010, at the date
of February 28, 2011 will be excluded from the archive if
VIES:
- they did not submit INTRASTAT forms in 2009 and 2010,
and
- they have not duly fulfilled obligations related to VAT
returns relevant to 2009.
VAT tax payers excluded from VIES who intend to carry out
intra-community transactions are obliged to declare their
will by filing an appropriate application to be submitted
directly at the offices of the Italian Revenue Agency.
