Content: Private international law deals<br />
with the problems that arise when the<br />
facts of a case are “connected” to different<br />
countries. The course has two principal<br />
parts: it first discusses the prerequisites<br />
for the exercise of jurisdiction over foreign<br />
defendants, questions of service<br />
and of obtaining evidence abroad, and<br />
the recognition and enforcement in one<br />
country of judgments ren<strong>der</strong>ed in another<br />
and defenses thereto. a second part deals<br />
with the question: which law applies? The<br />
primary focus is on the conflict law of the<br />
Eu with comparative consi<strong>der</strong>ation of us,<br />
canadian and chinese law.<br />

Content: The subject matter of this course<br />
is a sale of goods by a seller in one country<br />
to a buyer in another and the contractual<br />
relations between the various parties<br />
involved in the making and performance<br />
of such a sale. its focus is on a branch<br />
of English domestic law and the English<br />
rules governing international transactions<br />
(rules that are often applied to contracts<br />
which have no physical connection with<br />
England). The course materials and methods<br />
consist largely of a study of decided<br />
cases and legislation, though the latter is<br />
influenced by international conventions.<br />
internationally accepted customs and<br />
practices figure prominently in the banking<br />
section of the course.<br />
