Content: This course focuses on issues<br />
to be taken into account when drafting<br />
or enforcing an international commercial<br />
contract. it begins by outlining the different<br />
alternative dispute resolution possibilities<br />
before discussing international civil procedure<br />
relevant to international commercial<br />
contracts. The second part of the course<br />
focuses on private international law rules<br />
concerning international commercial contracts<br />
and on substantive laws that might<br />
be applicable to contracts. specific topics<br />
such as payment and bill of ladings and<br />
documents of title are also addressed.<br />

Content: The course begins with the “in-<br />
stitutional law” of the Eu: its history and<br />
development, the main characteristics of<br />
Eu law, its relation to national law, competences<br />
and tasks of the institutions of the<br />
Eu, judicial protection and fundamental<br />
rights. The second part of the course deals<br />
with “substantive law” of the Eu. it encompasses<br />
the “basic freedoms” as well as<br />
an introduction to Eu competition law. in<br />
both parts, reference is given to case law<br />
as provided for by the jurisprudence of the<br />
court of Justice of the European communities.<br />
