As a result <strong>of</strong> the audit, DECC provided verbal feedback <strong>and</strong> sent three warning letters to Forests NSW<br />
outlining the issues <strong>of</strong> non-compliance identified. DECC also required that remedial work be carried out<br />
at twelve locations.<br />
Lower North East (LNE) region<br />
In the LNE region DECC made four audits. EPL applied to 25 forestry operations, there were<br />
208 operations where harvesting occurred without EPL coverage <strong>and</strong> TSL applied to 233 forestry<br />
operations.<br />
The audits identified 88 non-compliances <strong>of</strong> EPL best practice conditions including:<br />
water flow issues with road drainage<br />
waste left at logging sites<br />
trees felled within protection zone<br />
incorrect marking up drainage lines <strong>and</strong> filter strips<br />
a culvert pipe blockage<br />
repeated instances <strong>of</strong> administration errors, for example incorrect or incomplete planning<br />
documents<br />
incorrect or insufficient drainage structures including drainage feature crossings <strong>and</strong> road<br />
drainage structures.<br />
DECC identified 41 non-compliances against TSL, which included:<br />
no/insufficient submission <strong>of</strong> TSL non-compliances<br />
harvesting machinery entering area <strong>of</strong> rainforest<br />
insufficient retention <strong>of</strong> Riparian Habitat Protection Zones<br />
damaged recruitment <strong>and</strong> habitat trees<br />
insufficient or incomplete surveys for threatened species.<br />
As a result <strong>of</strong> these auditing activities in the LNE forest region, DECC provided feedback <strong>and</strong> sent<br />
three warning letters to Forests NSW regarding non-compliance with licence conditions. Forests NSW<br />
was required to carry out remedial work at 10 sites <strong>and</strong> seek expert soil conservation advice on four<br />
occasions. DECC issued Forests NSW with two clean-up notices <strong>and</strong> two penalty notices for audits<br />
made between 1 July 2006 <strong>and</strong> 30 June <strong>2007</strong>.<br />
Forests NSW was also required to make one engineering assessment for LNE region.<br />
Southern region (South Coast sub-region)<br />
EPL coverage applied to 63 Forests NSW operations in the Southern region, there were 14 operations<br />
where harvesting occurred without EPL coverage <strong>and</strong> TSL applied to 77 forestry operations.<br />
NSW FOREST AGREEMENTS AND INTEGRATED FORESTRY OPERATIONS APPROVALS
