Voluntary mechanisms (such as VCAs) <strong>and</strong> principles that may help in conservation on private l<strong>and</strong> continue to be applied.<br />

Under the Native Vegetation Conservation Act 1997, the purpose <strong>of</strong> Registered Property Agreements <strong>and</strong> Management Contracts<br />

was to:<br />

• provide a mechanism for l<strong>and</strong>holders to adopt an integrated approach <strong>and</strong> appropriate strategies for the management <strong>of</strong> native<br />

vegetation on their l<strong>and</strong><br />

• protect native vegetation <strong>of</strong> high conservation value, to improve the condition <strong>of</strong> existing native vegetation <strong>and</strong> to encourage the<br />

revegetation <strong>of</strong> l<strong>and</strong> with appropriate native vegetation<br />

• provide incentives for l<strong>and</strong>holders to appropriately manage native vegetation on their l<strong>and</strong>.<br />

Property Agreements were registered on the title <strong>of</strong> the l<strong>and</strong> for periods up to, <strong>and</strong> including, in perpetuity. Management contracts<br />

were civil contracts for the designated period (typically 10 to 15 years). All existing property agreements <strong>and</strong> management contracts<br />

have been continued under the Native Vegetation Act 2003; however, no new ones can be signed. Over the life <strong>of</strong> the program, 842<br />

agreements (property agreements <strong>and</strong> management contracts) were signed to protect over 81 000 ha <strong>of</strong> native vegetation. A<br />

proposed ‘BioBanking’ scheme will establish a market-based framework for <strong>of</strong>fsetting ecosystem damage that may be caused by<br />

development. BioBanking will provide incentives for l<strong>and</strong>owners to protect <strong>and</strong> secure areas <strong>of</strong> high biodiversity. The scheme will<br />

provide a transparent, consistent <strong>and</strong> robust framework for assessing biodiversity values <strong>and</strong> for the long-term management <strong>of</strong><br />

biodiversity <strong>of</strong>fsets. The Native Vegetation Act 2003 came into operation on 1 December 2005. Under this Act, property vegetation<br />

plans can be agreed on between l<strong>and</strong>holders <strong>and</strong> CMAs for conservation works on private l<strong>and</strong>. However, CMAs are also delivering<br />

incentive funding by using other, non-statutory, forms <strong>of</strong> agreement.<br />

The new native vegetation framework has a strong emphasis on conservation, <strong>and</strong> $436 million has been allocated by the State <strong>and</strong><br />

Federal governments to the CMAs over four years to fund conservation activities.<br />
