NSW will ensure that an integrated code <strong>of</strong> practice is<br />

developed for plantation activities across all tenures<br />

under the Plantations <strong>and</strong> Reafforestation Act 1999.<br />

Existing plantations can also continue to obtain<br />

certainty for the purposes <strong>of</strong> harvesting as per the<br />

Timber Plantations (Harvest Guarantee) Act 1995 <strong>and</strong><br />

similar provisions included in the Plantations <strong>and</strong><br />

Reafforestation Act.<br />

For activities regulated under the Plantations <strong>and</strong><br />

Reafforestation Act 1999, plans must be prepared as<br />

required in the Plantations <strong>and</strong> Reafforestation (Code)<br />

Regulation 2001.<br />

With appropriate public involvement, <strong>and</strong> consistent<br />

with the Native Vegetation Conservation Act 1997, the<br />

regional vegetation management committees will<br />

pursue planning policies that provide for appropriate<br />

long-term, secure, management provisions for private<br />

native forests, including harvesting for commercial<br />

wood production.<br />

Improve administrative arrangements <strong>and</strong> cooperation<br />

<strong>and</strong> coordination by State agencies to facilitate the<br />

timber industry using private forest resources.<br />

Arrangements to ensure ESFM on private forests,<br />

involving the provision <strong>of</strong> technical advice, extension<br />

services, research <strong>and</strong> assistance in the estimation <strong>of</strong><br />

sustainable yield.<br />

Undertake a private forest inventory <strong>of</strong> southern NSW<br />

to determine the basis <strong>of</strong> yield <strong>of</strong> wood products from<br />

private l<strong>and</strong> is required, with the agreement <strong>of</strong> forest<br />

owner groups.<br />

Implemented<br />

This milestone was achieved with the implementation <strong>of</strong> the Plantations <strong>and</strong> Reafforestation (Code) Regulation 2001 in December<br />

2001. The Plantations <strong>and</strong> Reafforestation Act 1999 <strong>and</strong> the code provide certainty for harvesting, which was previously provided<br />

under the Timber Plantations (Harvest Guarantee) Act 1995. Plantations certified under the Timber Plantations (Harvest Guarantee)<br />

Act are deemed to be authorised under the Plantations <strong>and</strong> Reafforestation Act.<br />

A statutory review <strong>of</strong> the Act <strong>and</strong> code began in January 2005. As required, a <strong>Report</strong> to Parliament on the outcomes <strong>of</strong> the review was<br />

filed in December 2005. During 2006 <strong>and</strong> <strong>2007</strong>, inter-agency working groups developed amendments to the Act <strong>and</strong> code based on<br />

the recommendations in the report. An Industry Reference Group was consulted on the proposed amendments.<br />

It is intended to place the proposed amendments on public exhibition, providing an opportunity for comment by the broader<br />

community.<br />

An amendment Bill will then be introduced into Parliament.<br />

Implemented<br />

The Plantations <strong>and</strong> Reafforestation (Code) Regulation 2001 requires applicants for plantation authorisation to submit a plantation<br />

plan as part <strong>of</strong> their applications. Refer to clause 14 <strong>of</strong> the code. Operational plans are also required for specified plantation<br />

operations, i.e. site preparation involving ripping <strong>and</strong> ploughing, construction crossing rivers, <strong>and</strong> harvesting exceeding a certain<br />

volume. Refer to clauses 26 <strong>and</strong> 27 <strong>of</strong> the code. The requirements for plantation plans <strong>and</strong> operational plans will not be affected by<br />

review <strong>of</strong> the Act <strong>and</strong> code, although it is proposed that some additional items will be required to be shown on plantation plans.<br />
