Codes <strong>of</strong> practice for private plantations <strong>and</strong> private<br />

native forests will be in place within five years. The<br />

State will also provide advice regarding marketing <strong>and</strong><br />

pricing.<br />

As a means <strong>of</strong> encouraging private forestry<br />

development, the State will develop a regulatory<br />

framework that enables a more efficient integrated<br />

approval process to allow for effective private forestry<br />

development.<br />

Completed – native forest<br />

The Private Native Forestry Code <strong>of</strong> Practice came into effect on 1 August <strong>2007</strong> under the Native Vegetation Act 2003. With the<br />

introduction <strong>of</strong> the Code, all harvesting <strong>of</strong> native forests for the purposes <strong>of</strong> private native forestry requires approval through a property<br />

vegetation plan (which can last for up to 15 years), an existing consent under the Native Vegetation Conservation Act 1997 or the Soil<br />

Conservation Act 1938, or consent under the Native Vegetation Act 2003. The Code granted Biodiversity Certification under the<br />

Threatened Species Conservation Act 1995.<br />

Limited advice about marketing private native forestry products is provided through the NSW Private Forestry Development<br />

Committees. The PFDCs have also attempted to help form private forestry marketing cooperatives, which will help to secure markets<br />

for private forestry products. NSW, in cooperation with Australian Forest Growers (though funding from the Australian Government<br />

<strong>Department</strong> <strong>of</strong> Agriculture, Fisheries <strong>and</strong> Forestry – DAFF) has also supported the development <strong>of</strong> a group certification mechanism for<br />

private forest growers (both native forest <strong>and</strong> plantation products), which again will help provide access to markets for certified timber.<br />

Completed – plantations<br />

This milestone was achieved with the implementation <strong>of</strong> the Plantations <strong>and</strong> Reafforestation (Code) Regulation 2001 in December<br />

2001. The Plantations <strong>and</strong> Reafforestation Act 1999 <strong>and</strong> the code provide certainty for harvesting, which was previously provided<br />

under the Timber Plantations (Harvest Guarantee) Act 1995. Plantations certified under the Timber Plantations (Harvest Guarantee)<br />

Act 1995 are deemed to be authorised under the Plantations <strong>and</strong> Reafforestation Act 1999.<br />

A statutory review <strong>of</strong> the Act <strong>and</strong> code began in January 2005. As required, a report to Parliament on the outcomes <strong>of</strong> the review was<br />

filed in December 2005. During 2006 <strong>and</strong> <strong>2007</strong>, inter-agency working groups developed amendments to the Act <strong>and</strong> code based on<br />

the recommendations in the <strong>Report</strong>. An Industry Reference Group was consulted on the proposed amendments.<br />

It is intended to place the proposed amendments on public exhibition, providing an opportunity for comment by the broader<br />

community. An Amendment Bill will then be introduced into Parliament.<br />

Continuing<br />

The development <strong>of</strong> the regulatory framework highlighted in the milestone above will ensure a more efficient integrated approval<br />

process.<br />
