Criterion 7 – Legal, institutional <strong>and</strong> economic frameworks<br />
Legal framework<br />
MIG indicator 7.1 (narrative): Extent to which the legal framework (laws, regulations, guidelines) supports the conservation <strong>and</strong><br />
sustainable management <strong>of</strong> forests (UNE, LNE, Eden, Southern regions)<br />
The legal framework for sustainable management <strong>of</strong> forests <strong>and</strong> forest management is<br />
extensive. It includes legislation, amendments to existing legislation, policies, guidelines <strong>and</strong><br />
codes <strong>of</strong> practice.<br />
<strong>Report</strong>ing against this indicator is done at a statewide level, <strong>and</strong> when any policy or other<br />
document is specific to a region, it is indicated. The following discussion includes only<br />
information on the legal framework for forests <strong>and</strong> forest management not previously reported.<br />
Data <strong>and</strong> discussion<br />
In the 2004–2005 <strong>and</strong> 2006–<strong>2007</strong> reporting years the SoP qualitative survey data were introduced as<br />
the main source <strong>of</strong> PWG reporting data for ESFM <strong>and</strong> other internal <strong>and</strong> external reporting processes.<br />
The intent was to improve alignment <strong>and</strong> consistency between reporting systems. Data from the SoP<br />
qualitative survey is not available for reporting in the <strong>2007</strong>–<strong>2008</strong> reporting year.<br />
Additions <strong>and</strong> changes to legal framework<br />
Legislation<br />
The extent to which the legal frameworks in PWG provide for aspects <strong>of</strong> ecologically sustainable forest<br />
management has not changed from the previous reporting period.<br />
The table in Appendix 4 lists the main legislation relevant to sustainable forest management in NSW.<br />
For updates on specific legislation <strong>and</strong> legal changes relevant to Acts, new <strong>and</strong> amending Acts <strong>and</strong><br />
new <strong>and</strong> amending Regulations that are administered by DECC, refer to Appendix 7, page 195 <strong>of</strong> the<br />
DECC Annual <strong>Report</strong> <strong>2007</strong>–08.<br />
New <strong>and</strong> amending regulations reported on by DECC but not necessarily administered by PWG that<br />
may support the conservation <strong>and</strong> sustainable management <strong>of</strong> forests include:<br />
Native Vegetation Amendment (Miscellaneous) Regulation <strong>2008</strong><br />
Native Vegetation Amendment (Private Native Forestry) Regulation <strong>2007</strong><br />
Native Vegetation Amendment (Private Native Forestry – Transitional) Regulation <strong>2007</strong><br />
Management policies, guidelines <strong>and</strong> codes <strong>of</strong> practice<br />
The PR Act <strong>and</strong> Code provide a framework for sustainable plantation establishment <strong>and</strong> operation.<br />
The environmental st<strong>and</strong>ards included in the Code relate to aspects that include soil <strong>and</strong> water <strong>and</strong><br />
Aboriginal sites <strong>and</strong> relics. Biodiversity is protected by the requirement to retain certain native<br />
vegetation <strong>and</strong> manage it for biodiversity outcomes.<br />
