DECC made two proactive audits <strong>of</strong> Forests NSW operational <strong>and</strong> planning activities, <strong>and</strong> one reactive<br />

audit as a result <strong>of</strong> community complaints. These audits identified 52 non-compliances with the EPL<br />

including:<br />

incorrect or insufficient drainage structures, including snig track <strong>and</strong> extraction track drainage<br />

structures, as well as drainage feature crossings <strong>and</strong> road drainage structures<br />

insufficient soil stabilisation measures<br />

repeated instances <strong>of</strong> administration errors, for example incorrect or incomplete planning<br />

documents.<br />

DECC identified 108 non-compliances with TSL:<br />

incorrect or insufficient pre-logging <strong>and</strong> pre-roading surveys for threatened species including<br />

insufficient targeted survey planning <strong>and</strong> operation<br />

insufficient exclusion <strong>of</strong> forestry activities from areas <strong>of</strong> rainforest<br />

insufficient implementation <strong>of</strong> exclusion zones for streams <strong>and</strong> ridge <strong>and</strong> headwater habitat<br />

debris accumulated around tree.<br />

As a result <strong>of</strong> this audit, DECC provided feedback <strong>and</strong> sent three warning letters to Forests NSW<br />

regarding non-compliance with licence conditions. Forests NSW was required to carry out remedial<br />

work at six sites <strong>and</strong> seek expert soil conservation advice on two occasions.<br />

A clean-up notice was also issued as well as a non-compliance for section 120 <strong>of</strong> the Protection <strong>of</strong> the<br />

<strong>Environment</strong> Operations Act 1997.<br />

Tumut sub-region<br />

Eden region<br />

EPL applied to 22 forestry operations <strong>and</strong> TSL applied to 23 forestry operations in the Tumut subregion.<br />

There was one operation where harvesting occurred without EPL coverage. DECC made no<br />

audits <strong>and</strong> received no community complaints.<br />

EPL applied to 104 forestry operations <strong>and</strong> TSL applied to 104 forestry operations in the Eden region.<br />

There were no operations where harvesting occurred without EPL coverage.<br />

DECC undertook three audits within the region <strong>and</strong> identified a total <strong>of</strong> 108 non-compliances with<br />

licence conditions. Of these, 49 non-compliances were with EPL <strong>and</strong> included:<br />

machinery entering filter strips<br />

insufficient maintenance <strong>of</strong> existing log dams or gully stuffers<br />

insufficient soil stabilisation measures<br />

waste left at logging sites<br />

incorrect or insufficient drainage structures<br />
