Identification <strong>of</strong> areas ‘available for formal reservation’<br />

refined from the ‘areas for further consideration’.<br />

Process for identifying these l<strong>and</strong>s was outlined in the<br />

PlanningNSW memo dated 4 February 1999, <strong>and</strong><br />

entitled ‘Procedure for dealing with l<strong>and</strong>s for further<br />

consideration for reservation’.<br />

SFNSW must pursue upgrading to FMZ 2, <strong>and</strong> any<br />

FMZ 3 areas that would be classed as ‘available for<br />

formal reservation’ but for unresolved mineral issues.<br />

NPWS <strong>and</strong> SFNSW, in consultation with the<br />

<strong>Department</strong> <strong>of</strong> Mineral Resources, to complete<br />

negotiations on the FMZ category for State forests with<br />

mineral <strong>and</strong> lease interests.<br />

L<strong>and</strong>s must be zoned by SFNSW as FMZ 2, or FMZ 3<br />

where they are encumbered by leases or have major<br />

mineral value precluding FMZ 2, <strong>and</strong> must be<br />

managed accordingly. Any activities on these l<strong>and</strong>s<br />

that may diminish the values <strong>of</strong> the area must only be<br />

carried out with the agreement <strong>of</strong> NPWS <strong>and</strong> following<br />

consultation with leaseholders.<br />

Review <strong>of</strong> mineral <strong>and</strong> petroleum objections over<br />

FMZ 2 <strong>and</strong> FMZ 3 l<strong>and</strong>s every five years or as required<br />

<strong>and</strong> l<strong>and</strong> may be added to the dedicated reserve<br />

system.<br />

Consult with DMR when upgrading FMZ 3 to FMZ 2<br />

<strong>and</strong> purchase <strong>of</strong> leases.<br />

An FMZ assessment (made as part <strong>of</strong> the Government’s Action for the <strong>Environment</strong> Statement 2001) was completed in 2002; with the<br />

agreement <strong>of</strong> the <strong>Department</strong> <strong>of</strong> Mineral Resources it resulted in the transfer <strong>of</strong> up to 121 000 ha <strong>of</strong> FMZ 2 <strong>and</strong> 3 l<strong>and</strong>s to the formal<br />

reserve system through the National Park Estate (Reservations) Act 2002 (gazetted in January 2003). The review process is<br />

continuing as required <strong>and</strong> is concentrating on those FMZ2 <strong>and</strong> FMZ3 l<strong>and</strong>s that Forests NSW previously agreed to transfer by<br />

Forests NSW. Additional areas affected by the Government’s 2002 decision to exp<strong>and</strong> protection <strong>of</strong> old-growth forest on State forests<br />

will also be assessed in future reviews.<br />

No further progress on this milestone has occurred this year.<br />

St<strong>and</strong>ard DECC procedures for the purchase <strong>of</strong> leases apply to all purchases <strong>and</strong> involve referral to other government agencies such<br />

as DPI <strong>and</strong> the <strong>Department</strong> <strong>of</strong> L<strong>and</strong>s. Procedures for an approach to purchasing leases have not been developed with NSW Farmers<br />

because lessees make voluntary approaches to DECC. Therefore, there are <strong>of</strong>ten associated constraints on the information DECC<br />

can provide to third parties in such cases, due to confidentiality provisions.<br />

FMZ 2 <strong>and</strong> 3 l<strong>and</strong>s to the formal reserve system through the National Park Estate (Reservations) Act 2002 (gazetted in January<br />

2003). A further 34 059 ha <strong>of</strong> FMZ 1, 2, <strong>and</strong> 3a (10 411 ha <strong>of</strong> which are covered by lease) have been agreed to by Forests NSW, but<br />

not by DPI Minerals. The review process is continuing as required <strong>and</strong> is concentrating on those FMZ2 <strong>and</strong> FMZ3 l<strong>and</strong>s previously<br />

agreed to by Forests NSW. Additional areas affected by the Government’s 2002 decision to exp<strong>and</strong> protection <strong>of</strong> old growth forest in<br />

State forests shall also be assessed in future reviews. Discussions between DECC <strong>and</strong> DPI regarding another review <strong>of</strong> Mineral<br />

Resources objections over FMZs <strong>and</strong> upgrading <strong>of</strong> FMZs in the UNE <strong>and</strong> LNE regions is planned for 2009.<br />
