repeated instances <strong>of</strong> administration errors, for example incorrect or incomplete planning<br />
documents<br />
failure to comply with section 120 <strong>of</strong> the Protection <strong>of</strong> <strong>Environment</strong> Operations Act 1997.<br />
DECC identified 51 non-compliances with the TSL, which included:<br />
no/insufficient submission <strong>of</strong> TSL non-compliances<br />
harvesting machinery entering stream exclusion zone<br />
insufficient wetl<strong>and</strong> protection<br />
insufficient pre-logging <strong>and</strong> pre-roading surveys for threatened species<br />
damaged recruitment <strong>and</strong> habitat trees;<br />
DECC received two community complaints.<br />
As a result <strong>of</strong> these audits, DECC provided feedback to Forests NSW <strong>and</strong> issued three warning letters<br />
about non-compliance with EPL <strong>and</strong> TSL. Forests NSW was required by DECC to carry out remedial<br />
work at four sites <strong>and</strong> seek expert soil conservation advice at two sites.<br />
Fisheries licences<br />
DPI–Fisheries did not report any breaches <strong>of</strong> Fisheries Licences in any region during <strong>2007</strong>–<strong>2008</strong>.<br />
Non-licence terms<br />
DECC oversees the implementation <strong>of</strong>, <strong>and</strong> investigates complaints in relation to, non-licence terms 24<br />
in the UNE, LNE, Eden <strong>and</strong> Southern IFOAs. DECC also coordinates discussions about various IFOA<br />
implementation issues with DPI as they arise. Complaints about non-licence terms were received from<br />
the public during <strong>2007</strong>–<strong>2008</strong> <strong>and</strong> included those made in relation to:<br />
publicly available documents<br />
annual logging reports<br />
regeneration assessments<br />
clause 21 – principal purpose<br />
harvest planning<br />
enforcement<br />
timber volumes.<br />
In <strong>2007</strong>–<strong>2008</strong>, Forests NSW continued to draft a number <strong>of</strong> plans required under the non-licence<br />
terms, such as regional weed <strong>and</strong> feral animal management plans. Forests NSW also provided a<br />
number <strong>of</strong> programs in accordance with non-licence requirements.<br />
