GENERAL CONDITIONS<br />

ARTICLE 1: DEFINITIONS; GENERAL<br />

1.1 Architect. The Architect is the person or entity identified as such in the Agreement; references to the<br />

"Architect" includes the Architect's authorized representative <strong>and</strong> his, her or its successor(s).<br />

1.2 Construction Equipment. "Construction Equipment" is equipment utilized for the performance of any<br />

portion of the Work, but which is not incorporated into the Work.<br />

1.3 Contract Documents. The Contract Documents consist of the Agreement between the District <strong>and</strong> the<br />

Contractor, Conditions of the Contract (whether General, Special or otherwise), Drawings, Specifications, including<br />

addenda thereto issued prior to execution of the Agreement <strong>and</strong> any other documents listed in the Agreement. The<br />

Contract Documents shall include modifications issued after execution of the Agreement. The Contract Documents<br />

form the Contract for Construction.<br />

1.4 Contract Document Terms. The term "provide" means "provide complete in place" or to "furnish <strong>and</strong><br />

install" such item. Unless otherwise provided in the Contract Documents, the terms "approved;" "directed;"<br />

"satisfactory;" "accepted;" "acceptable;" "proper;" "required;" "necessary" <strong>and</strong> "equal" shall mean as approved,<br />

directed, satisfactory, accepted, acceptable, proper, required, necessary <strong>and</strong> equal, in the opinion of the District, its<br />

agents or representatives. The term "typical" as used in the Drawings shall require the installation or furnishing of<br />

such item(s) of the Work designated as "typical" in all other similar areas; Work in such other areas shall conform to<br />

that shown as "typical" or as reasonably inferable therefrom.<br />

1.5 Contractor. The Contractor is the person or entity identified as such in the Agreement; references to<br />

"Contractor" include the Contractor's authorized representative.<br />

1.6 Contractor's Superintendent. The Contractor's Superintendent is the individual employed by the<br />

Contractor whose principal responsibility shall be the supervision <strong>and</strong> coordination of the Work; the Contractor's<br />

Superintendent shall not perform routine construction labor.<br />

1.7 Days. Unless otherwise expressly stated, references to "days" in the Contract Documents shall be deemed<br />

to be calendar days.<br />

1.8 Deferred Approval Items. Deferred approval items are those items that shall not be started until detailed<br />

plans, specifications, <strong>and</strong> engineering calculations have been accepted <strong>and</strong> signed by the Architect or Engineer.<br />

1.9 District. The "District" refers to <strong>Citrus</strong> Community <strong>College</strong> District <strong>and</strong> its authorized representatives,<br />

including the Project Manager, the District's Board of Trustees <strong>and</strong> the District’s officers, employees, agents <strong>and</strong><br />

representatives.<br />

1.10 District's Inspector. The District's Inspector is the individual designated <strong>and</strong> employed by the District in<br />

accordance with the requirements of Title 24 of the California Code of Regulations. The District's Inspector shall be<br />

authorized to act on behalf of the District as provided for in the Contract Documents <strong>and</strong> in Title 24 of the California<br />

Code of Regulations, as the same may be amended from time to time.<br />

1.11 Division of State Architect ("DSA"). The DSA is the California Division of the State Architect including<br />

without limitation the DSA's Office of Construction Services, Office of Design Services <strong>and</strong> the Office of Regulation<br />

Services; references to the DSA in the Contract Documents shall mean the DSA, its offices <strong>and</strong> its authorized<br />

employees <strong>and</strong> agents. The authority of the DSA over the Work <strong>and</strong> the performance thereof shall be as set forth<br />

in the Contract Documents <strong>and</strong> Title 24 of the California Code of Regulations.<br />

1.12 Drawings <strong>and</strong> Specifications. The Drawings are the graphic <strong>and</strong> pictorial portions of the Contract<br />

Documents, wherever located <strong>and</strong> whenever issued, showing generally, the design, location <strong>and</strong> dimensions of the<br />

Work <strong>and</strong> may include without limitation, plans, elevations, sections, details, schedules, notes or diagrams. The<br />

Specifications are that portion of the Contract Documents consisting of the written requirements for materials,<br />

<strong>Citrus</strong> Community <strong>College</strong> District <strong>Bid</strong> Due Date: November 15, 2011 at 3:00: p.m.<br />
