Contract Time or the Contract Price shall be granted to the Contractor on account of its failure to make<br />

timely submission of any Submittals.<br />

4.8.2.2 Approval of Contractor’s Confirmation of Submittals. All Submittals prepared by<br />

Subcontractors, of any tier, Material Suppliers, manufacturers or distributors shall bear the written<br />

approval of the Contractor thereto prior to submission to the Architect for review. Any Submittal not<br />

bearing the Contractor's written approval shall be subject to return to the Contractor for re-submittal in<br />

conformity herewith, with the same being deemed to not have been submitted. Any delay, impact or<br />

cost associated therewith shall be the sole <strong>and</strong> exclusive responsibility of the Contractor without<br />

adjustment of the Contract Time or the Contract Price.<br />

4.8.2.3 Verification of Submittal Information. By approving <strong>and</strong> submitting Submittals, the<br />

Contractor represents to the District <strong>and</strong> Architect that the Contractor has determined <strong>and</strong> verified<br />

materials, field measurements, field construction criteria, catalog numbers <strong>and</strong> similar data related<br />

thereto <strong>and</strong> has checked <strong>and</strong> coordinated the information contained within such Submittals with the<br />

requirements of the Work <strong>and</strong> of the Contract Documents.<br />

4.8.2.4 Information Included in Submittals. All Submittals shall be accompanied by a written<br />

transmittal or other writing by the Contractor providing an identification of the portion of the Drawings or<br />

the Specifications pertaining to the Submittal, with each Submittal numbered consecutively for ease of<br />

reference along with the following information: (i) date of submission; (ii) project name; (iii) name of<br />

submitting Subcontractor; <strong>and</strong> (iv) if applicable, the revision number. The foregoing information is in<br />

addition to, <strong>and</strong> not in lieu of, any other information required for the Architect's review, evaluation <strong>and</strong><br />

approval of the Contractor's Submittals.<br />

4.8.2.5 Contractor Responsibility for Deviations. The Contractor shall not be relieved of<br />

responsibility for correcting deviations from the requirements of the Contract Documents by the<br />

Architect's approval of Submittals unless the Contractor has specifically informed the Architect in<br />

writing of such deviation at the time of submission of the Submittal <strong>and</strong> the District has given written<br />

approval to the specific deviation. The Contractor shall not be relieved of responsibility for errors or<br />

omissions in Submittals by the Architect’s approval thereof.<br />

4.8.2.6 No Performance of Work without Approval. The Contractor shall perform no portion of<br />

the Work requiring the Architect’s review <strong>and</strong> approval of Submittals until the Architect has completed<br />

its review <strong>and</strong> granted its approval of such Submittal. The Contractor shall not perform any portion of<br />

the Work forming a part of a Submittal or which is affected by a related Submittal until the entirety of<br />

the Submittal or other related Submittal has been fully approved.<br />

4.8.3 Architect Review of Submittals. The purpose of the Architect’s review of Submittals <strong>and</strong> the time<br />

for the Architect’s return of Submittals to the Contractor shall be as set forth elsewhere in the Contract<br />

Documents, including without limitation, Article 3.1.6 of the General Conditions. If the Architect returns a<br />

Submittal as rejected or requiring correction(s) <strong>and</strong> re-submission, the Contractor, so as not to delay the<br />

progress of the Work, shall promptly thereafter resubmit a Submittal conforming to the requirements of the<br />

Contract Documents; the resubmitted Submittal shall indicate the portions thereof modified in order to<br />

obtain the Architect's approval. When professional certification of performance criteria of materials,<br />

systems or equipment is required by the Contract Documents, the Architect shall be entitled to rely upon<br />

the accuracy <strong>and</strong> completeness of such calculations <strong>and</strong> certifications accompanying Submittals. The<br />

Architect's review of the Submittals is for the limited purposes described in the Contract Documents.<br />
