actual or potential impact of any such Conditions upon the completion of the Work within the Contract
Time. The Contract Time shall not be subject to adjustment in the event that the Contractor shall fail to
timely request information from the Architect. The Architect's responses to any such Contractor request for
information shall conform to the standards and time frame set forth in Article 3.1.9 of these General
Conditions. The foregoing provisions notwithstanding, in the event that the Architect reasonably
determines that any of Contractor's request(s) for information: (i) does not reflect adequate or competent
supervision or coordination by the Contractor or any Subcontractor; or (ii) does not reflect the Contractor's
adequate or competent knowledge of the requirements of the Work or the Contract Documents; or (iii) is
not justified for any other reason, Contractor shall be liable to the District for all costs incurred by the District
associated with the processing, reviewing, evaluating and responding to any such request for information,
including without limitation, fees of the Architect and any other design consultant to the Architect or the
District. In the event that the Architect makes such a determination, the District may deduct such costs
from any portion of the Contract Price then or thereafter due the Contractor.
4.2.5 Work in Accordance With Contract Documents. The Contractor shall perform all of the Work in
strict conformity with the Contract Documents and approved Submittals.
4.3 Site Investigation; Subsurface Conditions
4.3.1 Contractor Investigation. The Contractor shall be responsible for, and by executing the
Agreement acknowledges, that it has carefully examined the Site and has taken all steps it deems
reasonably necessary to ascertain all conditions which may affect the Work, or the cost thereof, including,
without limitation, conditions bearing upon transportation, disposal, handling or storage of materials;
availability of labor or utilities; access to the Site; and the physical conditions and the character of
equipment, materials, labor and services necessary to perform the Work. Any failure of the Contractor to
do so will not relieve it from the responsibility for fully and completely performing all Work without
adjustment to the Contract Price or the Contract Time. The District assumes no responsibility to the
Contractor for any understandings or representations concerning conditions or characteristics of the Site, or
the Work, made by any of its officers, employees or agents prior to the execution of the Agreement, unless
such understandings or representations are expressly set forth in the Agreement.
4.3.2 Subsurface Data. By executing the Agreement, the Contractor acknowledges that it has examined
the subsurface data available and satisfied itself as to the character, quality and quantity of surface and
subsurface materials, including without limitation, obstacles which may be encountered in performance of
the Work, insofar as this information is reasonably ascertainable from an inspection of the Site, review of
available subsurface data and analysis of information furnished by the District under the Contract
Documents. Subsurface data or other soils investigation report provided by the District hereunder are not a
part of the Contract Documents. Information contained in such data or report regarding subsurface
conditions, elevations of existing grades, or below grade elevations are approximate only and is neither
guaranteed nor warranted by the District to be complete and accurate. The Contractor shall examine all
subsurface data to make its own independent interpretation of the subsurface conditions and acknowledges
that its bid is based upon its own opinion of the conditions which may be encountered. The District
assumes no responsibility for any conclusions or interpretations made by Contractor on the basis of
available subsurface data or other information furnished by District under the Contract Documents.
4.3.3 Subsurface Conditions
