actual or potential impact of any such Conditions upon the completion of the Work within the Contract<br />
Time. The Contract Time shall not be subject to adjustment in the event that the Contractor shall fail to<br />
timely request information from the Architect. The Architect's responses to any such Contractor request for<br />
information shall conform to the st<strong>and</strong>ards <strong>and</strong> time frame set forth in Article 3.1.9 of these General<br />
Conditions. The foregoing provisions notwithst<strong>and</strong>ing, in the event that the Architect reasonably<br />
determines that any of Contractor's request(s) for information: (i) does not reflect adequate or competent<br />
supervision or coordination by the Contractor or any Subcontractor; or (ii) does not reflect the Contractor's<br />
adequate or competent knowledge of the requirements of the Work or the Contract Documents; or (iii) is<br />
not justified for any other reason, Contractor shall be liable to the District for all costs incurred by the District<br />
associated with the processing, reviewing, evaluating <strong>and</strong> responding to any such request for information,<br />
including without limitation, fees of the Architect <strong>and</strong> any other design consultant to the Architect or the<br />
District. In the event that the Architect makes such a determination, the District may deduct such costs<br />
from any portion of the Contract Price then or thereafter due the Contractor.<br />
4.2.5 Work in Accordance With Contract Documents. The Contractor shall perform all of the Work in<br />
strict conformity with the Contract Documents <strong>and</strong> approved Submittals.<br />
4.3 Site Investigation; Subsurface Conditions<br />
4.3.1 Contractor Investigation. The Contractor shall be responsible for, <strong>and</strong> by executing the<br />
Agreement acknowledges, that it has carefully examined the Site <strong>and</strong> has taken all steps it deems<br />
reasonably necessary to ascertain all conditions which may affect the Work, or the cost thereof, including,<br />
without limitation, conditions bearing upon transportation, disposal, h<strong>and</strong>ling or storage of materials;<br />
availability of labor or utilities; access to the Site; <strong>and</strong> the physical conditions <strong>and</strong> the character of<br />
equipment, materials, labor <strong>and</strong> services necessary to perform the Work. Any failure of the Contractor to<br />
do so will not relieve it from the responsibility for fully <strong>and</strong> completely performing all Work without<br />
adjustment to the Contract Price or the Contract Time. The District assumes no responsibility to the<br />
Contractor for any underst<strong>and</strong>ings or representations concerning conditions or characteristics of the Site, or<br />
the Work, made by any of its officers, employees or agents prior to the execution of the Agreement, unless<br />
such underst<strong>and</strong>ings or representations are expressly set forth in the Agreement.<br />
4.3.2 Subsurface Data. By executing the Agreement, the Contractor acknowledges that it has examined<br />
the subsurface data available <strong>and</strong> satisfied itself as to the character, quality <strong>and</strong> quantity of surface <strong>and</strong><br />
subsurface materials, including without limitation, obstacles which may be encountered in performance of<br />
the Work, insofar as this information is reasonably ascertainable from an inspection of the Site, review of<br />
available subsurface data <strong>and</strong> analysis of information furnished by the District under the Contract<br />
Documents. Subsurface data or other soils investigation report provided by the District hereunder are not a<br />
part of the Contract Documents. Information contained in such data or report regarding subsurface<br />
conditions, elevations of existing grades, or below grade elevations are approximate only <strong>and</strong> is neither<br />
guaranteed nor warranted by the District to be complete <strong>and</strong> accurate. The Contractor shall examine all<br />
subsurface data to make its own independent interpretation of the subsurface conditions <strong>and</strong> acknowledges<br />
that its bid is based upon its own opinion of the conditions which may be encountered. The District<br />
assumes no responsibility for any conclusions or interpretations made by Contractor on the basis of<br />
available subsurface data or other information furnished by District under the Contract Documents.<br />
4.3.3 Subsurface Conditions<br />
