4.11.5 Compliance with Proposition 65. Contractor is required to comply with the provisions of California<br />
Health <strong>and</strong> Safety Code §25249.5, et seq., which requires the posting <strong>and</strong> giving of notice to persons who<br />
may be exposed to any chemical known to the State of California to cause cancer. The Contractor agrees<br />
to familiarize itself with such statutory provisions <strong>and</strong> to fully comply with the requirements set forth therein.<br />
4.12 Maintenance of Documents<br />
4.12.1 Documents at Site. The Contractor shall maintain at the Site: (i) one record copy of the Drawings,<br />
Specifications <strong>and</strong> all addenda thereto; (ii) Change Orders approved by the District <strong>and</strong> all other<br />
modifications to the Contract Documents; (iii) Submittals reviewed by the Architect; (iv) Requests for<br />
Information <strong>and</strong> responses thereto; (v) Record Drawings; (vi) Material Safety Data Sheets (“MSDS”)<br />
accompanying any materials, equipment or products delivered or stored at the Site or incorporated into the<br />
Work; <strong>and</strong> (vii) all building <strong>and</strong> other codes or regulations applicable to the Work, including without<br />
limitation, Title 24, Part 2 of the California Code of Regulations. During performance of the Work, all<br />
documents maintained by Contractor at the Site shall be available to the District, the Project Manager, the<br />
Architect, the District’s Inspector <strong>and</strong> DSA for review, inspection or reproduction. Upon completion of the<br />
Work, all documents maintained at the Site by the Contractor pursuant to the foregoing, except for (vii),<br />
shall be assembled <strong>and</strong> transmitted to the District.<br />
4.12.2 Maintenance of Record Documents. During its performance of the Work, the Contractor shall<br />
continuously maintain Record Documents which are marked to indicate all field changes made to adapt the<br />
Work depicted in the Documents to field conditions, changes resulting from Change Orders <strong>and</strong> all<br />
concealed or buried installations, including without limitation, piping, conduit <strong>and</strong> utility services. The<br />
Record Documents shall be clean <strong>and</strong> all changes, corrections <strong>and</strong> dimensions shall be marked in a neat<br />
<strong>and</strong> legible manner in a contrasting color. The District’s inspection or review shall not be deemed to be the<br />
District's approval or verification of the completeness or accuracy of the Record Documents. The failure or<br />
refusal of the Contractor to continuously maintain complete <strong>and</strong> accurate Record Documents or to make<br />
available the Record Documents for inspection <strong>and</strong> review by the District may be deemed by the District to<br />
be Contractor's default of a material obligation hereunder. Payments to the Contractor are conditioned<br />
upon continuous maintenance <strong>and</strong> completion of the Record Documents pursuant to Articles 8.3.2 <strong>and</strong><br />
8.3.3. If the Contractor fails or refuses to continuously maintain the Record Documents in a complete <strong>and</strong><br />
accurate manner, the District may take appropriate action to cause such maintenance, <strong>and</strong> all costs<br />
incurred in connection therewith shall be charged to the Contractor; the District may deduct such costs from<br />
any portion of the Contract Price then or thereafter due the Contractor.<br />
4.13 Use of Site. The Contractor shall confine operations at the Site to areas permitted by law, ordinances or<br />
permits, subject to any restrictions or limitations set forth in the Contract Documents. The Contractor shall not<br />
unreasonably encumber the Site or adjoining areas with materials or equipment. The Contractor shall be solely<br />
responsible for providing security at the Site with all such costs included in the Contract Price. The District shall at<br />
all times have access to the Site.<br />
4.14 Noise <strong>and</strong> Dust Control. The Contractor shall be responsible for complying with the requirements of the<br />
city <strong>and</strong> county having jurisdiction with regard to noise ordinances governing construction sites <strong>and</strong> activities.<br />
Construction equipment noise is subject to the control of the Environmental Protection Agency’s Noise Control<br />
Program (Code of Federal Regulations, Title 40, Part 204). The Contractor shall be solely responsible for<br />
maintaining all areas of the Work free from all materials <strong>and</strong> products that by becoming airborne may cause<br />
respiratory inconveniences to District students <strong>and</strong> personnel. Damages <strong>and</strong>/or any liability derived from the<br />
Contractor’s failure to comply with these requirements shall be the sole cost of the Contractor, including all<br />
penalties incurred for violations of local, state <strong>and</strong>/or federal regulations.<br />
