approval of a Construction Schedule shall be for the sole <strong>and</strong> limited purpose of determining conformity<br />
with the requirements of the Contract Documents. By the Approved Construction Schedule, the District<br />
shall not be deemed to have exercised control over, or approval of, construction means, methods or<br />
sequences, all of which remain the responsibility <strong>and</strong> obligation of the Contractor in accordance with the<br />
terms of the Contract Documents. Further, the Approved Construction Schedule shall not operate to limit<br />
or restrict any of Contractor's obligations under the Contract Documents nor relieve the Contractor from the<br />
full, faithful <strong>and</strong> timely performance of such obligations in accordance with the terms of the Contract<br />
Documents. The activities, commencement <strong>and</strong> completion dates of activities, <strong>and</strong> the sequencing of<br />
activities depicted on the Approved Construction Schedule shall not be modified or revised by the<br />
Contractor without the prior consent, or direction, of the District. Updates to the Approved Construction<br />
Schedule pursuant to Article 7.3.5 below shall not be deemed revisions to the Approved Construction<br />
Schedule. In the event that the Approved Construction Schedule shall depict completion of the Work in a<br />
duration shorter than the Contract Time, the same shall not be a basis for an adjustment of the Contract<br />
Time or the Contract Price in the event that actual completion of the Work shall occur after such the time<br />
depicted in such Approved Construction Schedule. In such event, the Contract Price shall not be subject to<br />
adjustment on account of any additional costs incurred by the Contractor to complete the Work prior to the<br />
Contract Time, as adjusted in accordance with the terms of the Contract Documents. Any adjustment of<br />
the Contract Time or the Contract Price shall be based upon the Contract Time set forth in the Contract<br />
Documents <strong>and</strong> not any shorter duration which may depicted in the Approved Construction Schedule.<br />
7.3.4 Revisions to Approved Construction Schedule. In the event that the progress of the<br />
Work or the sequencing of the activities of the Work shall materially differ from that indicated in the<br />
Approved Construction Schedule, as determined by the District in its reasonable discretion <strong>and</strong> judgment,<br />
the District may direct the Contractor to revise the Approved Construction Schedule; within fifteen (15) days<br />
of the District's direction, the Contractor shall prepare <strong>and</strong> submit a revised Approved Construction<br />
Schedule, for review <strong>and</strong> approval by the District. The Contractor may request consent of the District to<br />
revise the Approved Construction Schedule. Any such request shall be considered by the District only if in<br />
writing setting forth the Contractor's proposed revision(s) to the Approved Construction Schedule <strong>and</strong> the<br />
reason(s) therefore. The District may consent to, or deny, any such request of the Contractor to revise the<br />
Approved Construction Schedule in its reasonable discretion.<br />
7.3.5 Updates to Approved Construction Schedule. The Contractor shall monitor <strong>and</strong> update<br />
the Approved Construction Schedule on a monthly basis, or more frequently as required by the conditions<br />
or progress of the Work, or as may be requested by the District. Proper <strong>and</strong> complete updating of the<br />
Approved Construction Schedule shall be a condition precedent to the issuance of progress payments<br />
described in Article 8 of these General Conditions. The Contractor shall provide the District with updated<br />
Approved Construction Schedules indicating progress achieved <strong>and</strong> activities commenced or completed<br />
within the prior updated Approved Construction Schedule. Updates to the Approved Construction Schedule<br />
shall not include any revisions to the activities, commencement <strong>and</strong> completion dates of activities or the<br />
sequencing of activities depicted on the Approved Construction Schedule. Any such revisions to the<br />
Approved Construction Schedule shall result in the District's rejection of such update <strong>and</strong> Contractor shall,<br />
within seven (7) days of the District's rejection of such update, submit to the Architect <strong>and</strong> the Project<br />
Manager an Updated Approved Construction Schedule which does not incorporate any such revisions. If<br />
requested by the District, the Contractor shall also submit, with its updates to the Approved Construction<br />
Schedule, a narrative statement including a description of current <strong>and</strong> anticipated problem areas of the<br />
Work, delaying factors <strong>and</strong> their impact, <strong>and</strong> an explanation of corrective action taken or proposed by the<br />
Contractor. If the progress of the Work is behind the Approved Construction Schedule, the Contractor shall<br />
indicate what measures will be taken to place the Work back on schedule. The District may, from time to<br />
time, <strong>and</strong> in the District's sole <strong>and</strong> exclusive discretion, transmit to the Contractor's Performance Bond<br />
Surety the Approved Construction Schedule, any updates thereof <strong>and</strong> the narrative statement described<br />
