4.15 Cutting <strong>and</strong> Patching. The Contractor shall be responsible for cutting, fitting or patching required to<br />
complete the Work or to make the component parts thereof fit together properly in accordance with the Contract<br />
Documents. Only tradespersons skilled <strong>and</strong> experienced in cutting <strong>and</strong> patching shall perform such work. The<br />
Contractor shall not damage or endanger any portion of the Work, or the fully or partially completed construction of<br />
the District or separate contractors by cutting, patching, excavation or other alteration. The Contractor shall not cut,<br />
patch or otherwise alter the construction by the District or separate contractor without the prior written consent of<br />
the District or separate contractor thereto, which consent shall not be unreasonably withheld. The Contractor shall<br />
not unreasonably withhold consent to the request of the District or separate contractor to cut, patch or otherwise<br />
alter the Work.<br />
4.16 Clean-Up. The Contractor shall at all times keep the Site <strong>and</strong> all adjoining areas free from the accumulation<br />
of any waste material, rubbish or excess materials <strong>and</strong> equipment, placed, caused by performance of the Work.<br />
This shall include cleaning all wall cavities <strong>and</strong> dead spaces prior to installing wallboard. The Contractor shall<br />
maintain the Site in a "rake-clean" st<strong>and</strong>ard on a daily basis. Prior to completion of the Work, Contractor shall<br />
remove from the Site all rubbish, waste <strong>and</strong> excess material, tools, Construction Equipment, machinery, temporary<br />
facilities <strong>and</strong> barricades, <strong>and</strong> any other items which are not the property of the District under the Contract<br />
Documents. Upon completion of the Work, the Site <strong>and</strong> all adjoining areas shall be left in a neat <strong>and</strong> broom clean<br />
condition satisfactory to District. The Project Manager is authorized to direct the Contractor's clean-up obligations<br />
hereunder. If the Contractor fails to clean up as provided for in the Contract Documents, the District may do so, <strong>and</strong><br />
all costs incurred in connection therewith shall be charged to the Contractor; the District may deduct such costs<br />
from any portion of the Contract Price then or thereafter due the Contractor.<br />
4.17 Access to the Work. The Contractor shall provide the DSA, the District, the Project Manager, the District's<br />
Inspector, the Architect <strong>and</strong> the Architect's consultant(s) with access to the Work, whether in place, preparation <strong>and</strong><br />
progress <strong>and</strong> wherever located.<br />
4.18 Information for the District's Inspector. The Contractor shall furnish the District's Inspector access to the<br />
Work for obtaining such information as may be necessary to keep the District's Inspector fully informed respecting<br />
the progress, quality <strong>and</strong> character of the Work <strong>and</strong> materials, equipment or other items incorporated therein.<br />
4.19 Facilities for District’s Inspector’s. The Contractor shall provide, at no additional cost or expense to the<br />
District, for use by the District, the Project Manager <strong>and</strong> the District’s Inspector, at the Site, a temporary trailer<br />
meeting or exceeding the requirements set forth in the Specifications, along with the items of furniture, furnishings<br />
<strong>and</strong> office equipment identified in the Specifications. The Contractor shall provide <strong>and</strong> pay for all costs, including<br />
without limitation, utility <strong>and</strong> telephone services associated with the use of such temporary trailer, until removal of<br />
the same is authorized by the District. The costs for providing of all such items pursuant to the foregoing shall be<br />
included within the Contract Price.<br />
4.20 Patents <strong>and</strong> Royalties. The Contractor <strong>and</strong> the Surety shall defend, indemnify <strong>and</strong> hold harmless the<br />
District <strong>and</strong> its agents, employees <strong>and</strong> officers from any claim, dem<strong>and</strong> or legal proceeding arising out of or<br />
pertaining, in any manner, to any actual or claimed infringement of patent rights in connection with performance of<br />
the Work under the Contract Documents.<br />
4.21 Prevailing Wage Rates; Employment of Labor<br />
4.21.1 Determination of Prevailing Rates. Pursuant to the provisions of Division 2, Part 7, Chapter 1,<br />
Article 2 of the California Labor Code at §§1770 et seq., the District has obtained from the Director of the<br />
Department of Industrial Relations the general prevailing rate of per diem wages <strong>and</strong> the prevailing rate for<br />
holiday <strong>and</strong> overtime work in the locality in which the Work is to be performed. These rates are on file at<br />
the District’s principal office. The Contractor shall post, at appropriate <strong>and</strong> conspicuous locations on the<br />
Site, a schedule showing all determined general prevailing wage rates.<br />
