In other Member States data indicate the existence of a number of cases. In Belgium at<br />

least 116 cases were h<str<strong>on</strong>g>and</str<strong>on</strong>g>led in 2006 (<str<strong>on</strong>g>and</str<strong>on</strong>g> 33 pers<strong>on</strong>s were granted refugee status)<br />

<str<strong>on</strong>g>and</str<strong>on</strong>g> at least 188 in 2007 (<str<strong>on</strong>g>and</str<strong>on</strong>g> 60 pers<strong>on</strong>s were granted refugee status). 338 In Sweden,<br />

Migrati<strong>on</strong>svärket [The Swedish Migrati<strong>on</strong> Board] estimated in 2002 the number of<br />

asylum applicants <strong>on</strong> grounds of sexual orientati<strong>on</strong> or gender identity to be<br />

approximately 300 per year. The Swedish Parliament decided in 2005 that people at risk<br />

of persecuti<strong>on</strong> <strong>on</strong> the basis of sex or sexual preference could be granted refugee status<br />

(Government Bill 2005/06:06). 339<br />

Sexual orientati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> gender identity in the applicati<strong>on</strong><br />

procedure<br />

Studies 340 indicate that the informati<strong>on</strong> about sexual orientati<strong>on</strong>, gender identity <str<strong>on</strong>g>and</str<strong>on</strong>g><br />

c<strong>on</strong>diti<strong>on</strong>s for LGBT pers<strong>on</strong>s in their country of origin c<strong>on</strong>tained in the country of origin<br />

reports used in refugee status determinati<strong>on</strong> procedures is often very limited. They also<br />

highlight that a key issue in the asylum applicati<strong>on</strong> procedures c<strong>on</strong>cerns the credibility of<br />

the asylum seeker. In cases regarding persecuti<strong>on</strong> <strong>on</strong> grounds of sexual orientati<strong>on</strong>, this<br />

feature in itself becomes a questi<strong>on</strong> of critical inquiry, <str<strong>on</strong>g>and</str<strong>on</strong>g> several accounts report that<br />

“those making asylum claims often do not believe that an asylum seeker is really LGBT”.<br />

There are at least two reas<strong>on</strong>s for this. First, certain identities, expressi<strong>on</strong>s <str<strong>on</strong>g>and</str<strong>on</strong>g> practices<br />

are perceived to be more credible than others. As an example from Denmark shows,<br />

changing sexual preferences or bisexuality can be suspicious:<br />

'And there are some cases where people are homosexual <str<strong>on</strong>g>and</str<strong>on</strong>g> then in a way they are<br />

not. It can be hard to assess. We had <strong>on</strong>e [applicant] who said that he was<br />

homosexual, but now he was not anymore because he did not think it was fun<br />

anymore. We also meet such things, <str<strong>on</strong>g>and</str<strong>on</strong>g> it can be difficult to take it seriously.' 341<br />

Similarly, asylum decisi<strong>on</strong>-makers may interpret the fact that an applicant is or was<br />

married or otherwise engaged in a heterosexual relati<strong>on</strong>ship, or that he has children, as<br />

indicati<strong>on</strong> of heterosexuality.<br />
