Hate speech<br />

The term ‘hate speech’, as used in this secti<strong>on</strong>, includes a broader spectrum of verbal<br />

acts drawing up<strong>on</strong> or expressing homophobia <str<strong>on</strong>g>and</str<strong>on</strong>g>/or transphobia in degrading or<br />

disrespectful public discourse.<br />

Based <strong>on</strong> available data, it is possible to identify at least three types of hate speech as<br />

having particular importance in a homophobic c<strong>on</strong>text: hate speech by public figures,<br />

hate speech by public religious figures <str<strong>on</strong>g>and</str<strong>on</strong>g> hate speech published, often an<strong>on</strong>ymously,<br />

<strong>on</strong> the Internet.<br />

Hate speech by public <str<strong>on</strong>g>and</str<strong>on</strong>g> religious figures<br />

Some LGBT NGOs <str<strong>on</strong>g>and</str<strong>on</strong>g> researchers have m<strong>on</strong>itored statements in the press or<br />

elsewhere. In Latvia <str<strong>on</strong>g>and</str<strong>on</strong>g> Lithuania, the LGBT NGOs Mozaika (Latvia) <str<strong>on</strong>g>and</str<strong>on</strong>g> The<br />

Lithuanian Gay League have identified articulati<strong>on</strong> patterns examining anti-LGBT<br />

statements <str<strong>on</strong>g>and</str<strong>on</strong>g> other homophobic expressi<strong>on</strong>s that may not strictly speaking all fall<br />

under the legal definiti<strong>on</strong> of hate speech. 108<br />

These m<strong>on</strong>itoring projects found that anti-LGBT statements are mainly articulated by<br />

c<strong>on</strong>servative politicians <str<strong>on</strong>g>and</str<strong>on</strong>g> religious (Catholic, Lutheran or Evangelical Christian) public<br />

figures. These statements mainly draw up<strong>on</strong> the theme that LGBT pers<strong>on</strong>s <str<strong>on</strong>g>and</str<strong>on</strong>g> ways of<br />

living c<strong>on</strong>stitute a threat to society. As Mozaika phrases it: 'it became clear that certain<br />

types of arguments were being used over <str<strong>on</strong>g>and</str<strong>on</strong>g> over again to speak out against lesbians<br />

<str<strong>on</strong>g>and</str<strong>on</strong>g> gays'. 109 Am<strong>on</strong>g these are arguments: 110<br />

• aiming to preserve the ethnic homogeneity <str<strong>on</strong>g>and</str<strong>on</strong>g> integrity of the nati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> the<br />

state by excluding or subordinating gays <str<strong>on</strong>g>and</str<strong>on</strong>g> lesbians;<br />

• drawing up<strong>on</strong> Christian belief to support the exclusi<strong>on</strong> of gays <str<strong>on</strong>g>and</str<strong>on</strong>g> lesbians<br />

from the ‘moral community’ which is understood as encompassing the entire<br />

nati<strong>on</strong>;<br />

• referring to an unspecified morality, often invoking family values to argue for the<br />

exclusi<strong>on</strong> or subordinati<strong>on</strong> of gays <str<strong>on</strong>g>and</str<strong>on</strong>g> lesbians.<br />

Additi<strong>on</strong>ally, in some statements LGBT pers<strong>on</strong>s appear as a ‘western threat’ to the<br />

‘demographic survival’ of the nati<strong>on</strong> from abroad:<br />
