I.4. The labour market<br />

This secti<strong>on</strong> examines a variety of issues regarding discriminati<strong>on</strong> <strong>on</strong> grounds of sexual<br />

orientati<strong>on</strong> in employment, namely the invisibility of LGBT pers<strong>on</strong>s, how LGBT pers<strong>on</strong>s<br />

access their rights in the labour market, evidence of the level of experienced<br />

discriminati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> homophobia in the workplace, the prevalence of discriminati<strong>on</strong> in the<br />

labour market, <str<strong>on</strong>g>and</str<strong>on</strong>g> employers’ attitudes <str<strong>on</strong>g>and</str<strong>on</strong>g> resp<strong>on</strong>sibilities towards LGBT pers<strong>on</strong>s.<br />

Openness versus invisibility of LGBT pers<strong>on</strong>s<br />

In all Member States, LGBT NGOs interviewed in the field suggested that many LGB<br />

people are not visible in the labour market. This finding was supported in interviews with<br />

Nati<strong>on</strong>al Equality Bodies <str<strong>on</strong>g>and</str<strong>on</strong>g> public authorities in all 27 Member States. 148 As the<br />

Commissi<strong>on</strong> has noted, ‘the group subject to discriminati<strong>on</strong> is hardly identified in the<br />

public statistics <str<strong>on</strong>g>and</str<strong>on</strong>g> does not always wish to be… We were told that discriminati<strong>on</strong><br />

based <strong>on</strong> sexual orientati<strong>on</strong> occurred <strong>on</strong>ce a pers<strong>on</strong> had been hired <str<strong>on</strong>g>and</str<strong>on</strong>g> <strong>on</strong>ce the<br />

informati<strong>on</strong> <strong>on</strong> the pers<strong>on</strong>’s sexuality had been revealed, whether willingly or not.’ 149<br />

According to an ILGA-Europe report 150 , 42 per cent of LGB resp<strong>on</strong>dents are not 'out' in<br />

their workplace. Sixty-six per cent name fear of reprisals as a factor in their choice to<br />

remain hidden.<br />

A Swedish survey 151 c<strong>on</strong>ducted by the Arbetslivsinstitutet [The Nati<strong>on</strong>al Institute for<br />

Working Life], showed that 50 per cent of LGB resp<strong>on</strong>dents were not open at work. Forty<br />

per cent of these avoided socialising due to fear of being 'revealed'.<br />

In a German survey 152 of 2,230 gay <str<strong>on</strong>g>and</str<strong>on</strong>g> lesbian employees, <str<strong>on</strong>g>and</str<strong>on</strong>g> showed a similar<br />

pattern: 52 per cent of gays <str<strong>on</strong>g>and</str<strong>on</strong>g> lesbians either didn’t reveal their sexual orientati<strong>on</strong> to<br />

their colleagues or revealed it <strong>on</strong>ly to a few. Disclosure to supervisors or executives was<br />

much lower (65.1 per cent did not reveal or revealed <strong>on</strong>ly to a few supervisors or<br />

executives). In specific work sectors, for example the military <str<strong>on</strong>g>and</str<strong>on</strong>g> the church, disclosure<br />

is much lower than average.<br />
