Interviews with Nati<strong>on</strong>al Equality Bodies <str<strong>on</strong>g>and</str<strong>on</strong>g> LGBT NGOS in all 27 Member States<br />

highlighted the fact that despite the implementati<strong>on</strong> of EU legislati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> transpositi<strong>on</strong> of<br />

such law in nati<strong>on</strong>al legislati<strong>on</strong> around the EU, the amount of substantiated sexual<br />

orientati<strong>on</strong> discriminati<strong>on</strong> cases is remarkably low.<br />

In Latvia, the Office of the Ombudsman <str<strong>on</strong>g>and</str<strong>on</strong>g> the LGBT NGO Mozaika suggest that the<br />

low number of discriminati<strong>on</strong> cases can be attributed to a number of reas<strong>on</strong>s, such as<br />

the reluctance of LGBT pers<strong>on</strong>s to deal with the publicity of a court case <str<strong>on</strong>g>and</str<strong>on</strong>g> the lack of<br />

recogniti<strong>on</strong> of the problems they face as discriminati<strong>on</strong>. 166<br />

As a representative from the LGBT NGO Mozaika, put it during interview: ‘Generally<br />

people are not open about their sexual orientati<strong>on</strong> at work <str<strong>on</strong>g>and</str<strong>on</strong>g> they d<strong>on</strong>’t know their<br />

rights <str<strong>on</strong>g>and</str<strong>on</strong>g> want to avoid publicity. There is also the issue of internalised homophobia;<br />

Latvian society is so homophobic that LGBT people adopt negative views about<br />

themselves.’ 167<br />

At interview, the LGBT NGO Campaign Against <str<strong>on</strong>g>Homophobia</str<strong>on</strong>g> in Pol<str<strong>on</strong>g>and</str<strong>on</strong>g> noted that for<br />

LGBT pers<strong>on</strong>s, filing a complaint poses a risk of losing <strong>on</strong>e’s job. 168 With Pol<str<strong>on</strong>g>and</str<strong>on</strong>g>’s<br />

relatively high unemployment rate, LGBT pers<strong>on</strong>s are fearful of being victimised, <str<strong>on</strong>g>and</str<strong>on</strong>g><br />

filing a complaint against an employer is perceived as lowering the chances of finding<br />

new employment. 169 A representative from The Equality Authority in Irel<str<strong>on</strong>g>and</str<strong>on</strong>g> informed<br />

interviewers that due to fear of publicity, even LGBT pers<strong>on</strong>s who are well aware of their<br />

rights are reluctant to come forward <str<strong>on</strong>g>and</str<strong>on</strong>g> make claims. 170<br />

In Greece, some limited discriminati<strong>on</strong> testing research 171 showed that <strong>on</strong>e in four<br />

employers were reluctant to call c<str<strong>on</strong>g>and</str<strong>on</strong>g>idates which they know or presume are gay (‘gaylabelled’)<br />

to job interviews. This percentage is higher for male employers (1 in 3).<br />

In France, the LGBT NGOs Inter LGBT <str<strong>on</strong>g>and</str<strong>on</strong>g> L’Autre Cercle told interviewers of 'a<br />

missing link' between the word 'discriminati<strong>on</strong>' <str<strong>on</strong>g>and</str<strong>on</strong>g> sexual orientati<strong>on</strong>: ''When you<br />

menti<strong>on</strong> the word 'discriminati<strong>on</strong>' people automatically think of gender <str<strong>on</strong>g>and</str<strong>on</strong>g><br />

race/ethnicity—whereas the other grounds, including sexual orientati<strong>on</strong>, are left far<br />

behind. '' 172<br />

Good practice: In France, HALDE [High Authority for the Fight Against <str<strong>on</strong>g>Discriminati<strong>on</strong></str<strong>on</strong>g><br />

<str<strong>on</strong>g>and</str<strong>on</strong>g> for Equality] has developed <str<strong>on</strong>g>and</str<strong>on</strong>g> distributed the Diversity Charter [la charte de la<br />
