Clarificati<strong>on</strong> of terms <str<strong>on</strong>g>and</str<strong>on</strong>g> c<strong>on</strong>cepts<br />

The FRA undertakes its work <strong>on</strong> discriminati<strong>on</strong> based <strong>on</strong> sex, race or ethnic origin,<br />

religi<strong>on</strong> or belief, disability, age or sexual orientati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> against pers<strong>on</strong>s bel<strong>on</strong>ging to<br />

minorities <str<strong>on</strong>g>and</str<strong>on</strong>g> any combinati<strong>on</strong> of these grounds (multiple discriminati<strong>on</strong>) <strong>on</strong> the basis of<br />

EU <str<strong>on</strong>g>and</str<strong>on</strong>g> internati<strong>on</strong>al st<str<strong>on</strong>g>and</str<strong>on</strong>g>ards to combat discriminati<strong>on</strong>, promote equal treatment <str<strong>on</strong>g>and</str<strong>on</strong>g><br />

guarantee fundamental rights. These st<str<strong>on</strong>g>and</str<strong>on</strong>g>ards c<strong>on</strong>tain definiti<strong>on</strong>s, terms <str<strong>on</strong>g>and</str<strong>on</strong>g> c<strong>on</strong>cepts,<br />

which provide a framework for the FRA’s data collecti<strong>on</strong> methodology <str<strong>on</strong>g>and</str<strong>on</strong>g> analysis.<br />

<str<strong>on</strong>g>Discriminati<strong>on</strong></str<strong>on</strong>g> 11 is the less favourable treatment of a pers<strong>on</strong> or group than another <strong>on</strong><br />

various grounds, including sexual orientati<strong>on</strong> (direct discriminati<strong>on</strong>), or where an<br />

apparently neutral provisi<strong>on</strong> is liable to disadvantage a group of pers<strong>on</strong>s <strong>on</strong> the same<br />

grounds of discriminati<strong>on</strong>, unless objectively justified (indirect discriminati<strong>on</strong>). 12<br />

Harassment shall be deemed to be a form of discriminati<strong>on</strong> when unwanted c<strong>on</strong>duct<br />

related to any of the grounds takes place with the purpose or effect of violating the<br />

dignity of a pers<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> of creating an intimidating, hostile, degrading, humiliating or<br />

offensive envir<strong>on</strong>ment. Harassment can c<strong>on</strong>sist of a single incident or several incidents<br />

over a period of time. It can take many forms, such as: threats, intimidati<strong>on</strong>, or verbal<br />

abuse; unwelcome remarks or jokes about sexual orientati<strong>on</strong>, gender identity or gender<br />

expressi<strong>on</strong>. 13<br />

Hate crime toward LGBT pers<strong>on</strong>s refers to any criminal offence, including offences<br />

against pers<strong>on</strong>s or property, where the victim, premises or target of the offence were<br />

selected because of their real or perceived c<strong>on</strong>necti<strong>on</strong>, attachment, affiliati<strong>on</strong>, support or<br />

membership of an LGBT group. 14<br />

Hate incident is any incident, assault or act—whether defined as criminal by nati<strong>on</strong>al<br />

legislati<strong>on</strong> or not—against people or property that involves a victim, premises or target<br />

selected because of their real or perceived c<strong>on</strong>necti<strong>on</strong>, attachment, affiliati<strong>on</strong>, support or<br />

membership of an LGBT group. The term covers a range of manifestati<strong>on</strong>s of<br />

intolerance, from low-level incidents motivated by bias to criminal acts. 15<br />

Hate speech refers to public expressi<strong>on</strong>s which spread, incite, promote or justify hatred,<br />

discriminati<strong>on</strong> or hostility towards minorities — for example statements by political or<br />

religious leaders appearing in the press or the Internet. There is no universally agreed<br />
