Executive Summary<br />

Background<br />

The principle of equal treatment c<strong>on</strong>stitutes a fundamental value of the European Uni<strong>on</strong>.<br />

The Charter of Fundamental Rights of the European Uni<strong>on</strong> is the first internati<strong>on</strong>al<br />

human rights instrument to explicitly prohibit discriminati<strong>on</strong> <strong>on</strong> the basis of “sexual<br />

orientati<strong>on</strong>” in its Article 21 (1):<br />

“Any discriminati<strong>on</strong> based <strong>on</strong> any ground such as sex, race, colour, ethnic or social<br />

origin, genetic features, language, religi<strong>on</strong> or belief, political or other opini<strong>on</strong>,<br />

membership of a nati<strong>on</strong>al minority, property, birth, disability, age or sexual orientati<strong>on</strong><br />

shall be prohibited”.<br />

Until the Treaty of Amsterdam, the focus of EU legal acti<strong>on</strong> in this respect was <strong>on</strong><br />

preventing discriminati<strong>on</strong> <strong>on</strong> the grounds of nati<strong>on</strong>ality <str<strong>on</strong>g>and</str<strong>on</strong>g> sex. Article 13 of the<br />

Amsterdam Treaty granted the Community new powers to combat discriminati<strong>on</strong> <strong>on</strong> the<br />

grounds of sex, racial or ethnic origin, religi<strong>on</strong> or belief, disability, age or sexual<br />

orientati<strong>on</strong>. C<strong>on</strong>sequently, two new EC Directives were enacted in the area of antidiscriminati<strong>on</strong>:<br />

the Racial Equality Directive <str<strong>on</strong>g>and</str<strong>on</strong>g> the Employment Equality Directive.<br />

However, protecti<strong>on</strong> against discriminati<strong>on</strong> <strong>on</strong> grounds of sexual orientati<strong>on</strong> is <strong>on</strong>ly<br />

provided by the Employment Equality Directive in the area of employment <str<strong>on</strong>g>and</str<strong>on</strong>g> work.<br />

In June 2007 the European Parliament asked the Fundamental Rights Agency to<br />

develop a comprehensive, comparative report <strong>on</strong> the situati<strong>on</strong> regarding homophobia<br />

<str<strong>on</strong>g>and</str<strong>on</strong>g> discriminati<strong>on</strong> based <strong>on</strong> sexual orientati<strong>on</strong> in the Member States of the European<br />

Uni<strong>on</strong> with the aim of assisting the Committee <strong>on</strong> Civil Liberties, Justice <str<strong>on</strong>g>and</str<strong>on</strong>g> Home<br />

Affairs of the European Parliament, when discussing the need for a Directive covering all<br />

grounds of discriminati<strong>on</strong> listed in Article 13 of the EC Treaty for all sectors referred to in<br />

the Racial Equality Directive 2000/43/EC. These sectors are educati<strong>on</strong>, social security,<br />

healthcare, <str<strong>on</strong>g>and</str<strong>on</strong>g> access to goods <str<strong>on</strong>g>and</str<strong>on</strong>g> services.<br />

In resp<strong>on</strong>se the Agency prepared <str<strong>on</strong>g>and</str<strong>on</strong>g> launched a major project in December 2007<br />

composed, following its socio-legal interdisciplinary methodology, of two parts. The first<br />

part, published in June 2008, c<strong>on</strong>tains a comprehensive, comparative legal analysis of<br />

the situati<strong>on</strong> in the European Uni<strong>on</strong> Member States. The comparative legal analysis was<br />

based <strong>on</strong> 27 nati<strong>on</strong>al legal studies covering all EU Member States drafted <strong>on</strong> the basis<br />

of detailed guidelines provided by the FRA. The sec<strong>on</strong>d part, which is the present<br />

publicati<strong>on</strong>, is a comprehensive, comparative social analysis, based <strong>on</strong> available data<br />

throughout the European Uni<strong>on</strong>, as well as fieldwork research c<strong>on</strong>sisting of interviews<br />
