discussed in this secti<strong>on</strong>. Three principal means of protecti<strong>on</strong> against discriminati<strong>on</strong><br />
based <strong>on</strong> transgenderism can be found am<strong>on</strong>g EU Member States:<br />
Firstly, discriminati<strong>on</strong> <strong>on</strong> the basis of transgenderism may be interpreted to fall within<br />
discriminati<strong>on</strong> <strong>on</strong> the basis of sex within instruments prohibiting discriminati<strong>on</strong> between<br />
men <str<strong>on</strong>g>and</str<strong>on</strong>g> women. Thirteen EU Member States fall within this category (Belgium,<br />
Denmark, France, Irel<str<strong>on</strong>g>and</str<strong>on</strong>g>, Italy, Latvia, 388 The Netherl<str<strong>on</strong>g>and</str<strong>on</strong>g>s, 389 Austria, 390 Pol<str<strong>on</strong>g>and</str<strong>on</strong>g>,<br />
Slovakia, 391 Finl<str<strong>on</strong>g>and</str<strong>on</strong>g>, Sweden, United Kingdom). 392<br />
Sec<strong>on</strong>dly, it may be interpreted to fall within discriminati<strong>on</strong> <strong>on</strong> the basis of sexual<br />
orientati<strong>on</strong>. Two Member States fall within this category (Germany, 393 Spain).<br />
Thirdly, it may be interpreted to fall within a general prohibiti<strong>on</strong> <strong>on</strong> discriminati<strong>on</strong>, with no<br />
express articulati<strong>on</strong> of sex or sexual orientati<strong>on</strong> as the prohibited grounds. The result is a<br />
situati<strong>on</strong> of legal uncertainty as to the precise protecti<strong>on</strong> of transgender pers<strong>on</strong>s from<br />
discriminati<strong>on</strong>. Eleven Member States fall within this category (Bulgaria, Czech Republic,<br />
Est<strong>on</strong>ia, Greece, Cyprus, Lithuania, Luxembourg, Malta, Portugal, Romania, <str<strong>on</strong>g>and</str<strong>on</strong>g><br />
Slovenia).<br />
Finally, Hungary, addresses discriminati<strong>on</strong> based <strong>on</strong> transgenderism <strong>on</strong> the grounds of<br />
sexual identity under Act <strong>on</strong> Equal Treatment. 394<br />

In the UK also, where a pers<strong>on</strong> can obtain a Gender Recogniti<strong>on</strong> Certificate under the Gender<br />
Recogniti<strong>on</strong> Act 2004 (GRA) it would not be lawful to discriminate other than <strong>on</strong> grounds that would<br />
legally apply to any<strong>on</strong>e else of his or her acquired gender. (There is <strong>on</strong>e excepti<strong>on</strong>: it is possible for an<br />
organised religi<strong>on</strong> to discriminate where there are genuine religious reas<strong>on</strong>s to refuse to employ a<br />
transsexual pers<strong>on</strong> even if the pers<strong>on</strong> has a Gender Recogniti<strong>on</strong> Certificate).<br />
