more public awareness <strong>on</strong> LGBT issues <str<strong>on</strong>g>and</str<strong>on</strong>g> empower LGBT people, especially when<br />
such organisati<strong>on</strong>s receive no financial or other support by the state, by providing<br />
resources <str<strong>on</strong>g>and</str<strong>on</strong>g> protecti<strong>on</strong> against homophobic counter-dem<strong>on</strong>strati<strong>on</strong>s.<br />
12. Member States, <str<strong>on</strong>g>and</str<strong>on</strong>g> particularly local <str<strong>on</strong>g>and</str<strong>on</strong>g> regi<strong>on</strong>al authorities should, in this c<strong>on</strong>text,<br />
have regard to Recommendati<strong>on</strong> 211 (2007) of the C<strong>on</strong>gress of Local <str<strong>on</strong>g>and</str<strong>on</strong>g> Regi<strong>on</strong>al<br />
Authorities of the Council of Europe 4 <strong>on</strong> freedom of assembly <str<strong>on</strong>g>and</str<strong>on</strong>g> expressi<strong>on</strong> for<br />
lesbians, gays, bisexuals <str<strong>on</strong>g>and</str<strong>on</strong>g> transgendered pers<strong>on</strong>s calling, inter alia, for: the<br />
applicati<strong>on</strong> of the (forthcoming) Guidelines <strong>on</strong> Freedom of Peaceful Assembly drafted by<br />
the OSCE/ODIHR Expert Panel <strong>on</strong> freedom of assembly; for rigorous investigati<strong>on</strong> of all<br />
cases of violence or hate speech during LGBT or LGBT-related events; for positive<br />
measures as required by the European Court of Human Rights to guarantee effective<br />
freedom of assembly <str<strong>on</strong>g>and</str<strong>on</strong>g> expressi<strong>on</strong> at state, local <str<strong>on</strong>g>and</str<strong>on</strong>g> regi<strong>on</strong>al level; for c<strong>on</strong>sultati<strong>on</strong><br />
with LGBT groups when reforming legal measures that interfere with freedom of<br />
expressi<strong>on</strong> or assembly.<br />
Improving asylum procedures <str<strong>on</strong>g>and</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>s<br />
13. Member States should develop c<strong>on</strong>crete criteria <str<strong>on</strong>g>and</str<strong>on</strong>g> guidelines for the treatment of<br />
LGBT asylum seekers <str<strong>on</strong>g>and</str<strong>on</strong>g> for the h<str<strong>on</strong>g>and</str<strong>on</strong>g>ling of issues of sexual orientati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> gender<br />
identity in the applicati<strong>on</strong> procedures. In this respect authorities could be guided by the<br />
UNHCR Guidance Note <strong>on</strong> Refugee Claims Relating to Sexual Orientati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> Gender<br />
Identity 5 published <strong>on</strong> 21 November 2008 is particularly useful.<br />
14. Member States should ensure that officials dealing with LGBT immigrants <str<strong>on</strong>g>and</str<strong>on</strong>g><br />
asylum seekers are aware of issues of sexual orientati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> gender identity <str<strong>on</strong>g>and</str<strong>on</strong>g><br />
appropriately trained to deal with these pers<strong>on</strong>s.<br />
15. Member States should pay particular attenti<strong>on</strong> to the special needs <str<strong>on</strong>g>and</str<strong>on</strong>g> issues of<br />
LGBT pers<strong>on</strong>s held in detenti<strong>on</strong> centres.<br />
Ensuring equal treatment in the labour market<br />
16. Social partners should facilitate the active participati<strong>on</strong> of LGBT pers<strong>on</strong>s in their<br />
organisati<strong>on</strong>s <str<strong>on</strong>g>and</str<strong>on</strong>g> encourage public <str<strong>on</strong>g>and</str<strong>on</strong>g> private sector employers to adopt <str<strong>on</strong>g>and</str<strong>on</strong>g><br />
implement diversity <str<strong>on</strong>g>and</str<strong>on</strong>g> equal treatment policies in the workplace.<br />
