Standard PPA <strong>for</strong> … [Insert ‘medium’ or ‘long’, as applicable] term power procurement under Case -1<br />

5.5 Demonstration <strong>of</strong> <strong>Power</strong> Station’s Net Capacity<br />

5.5.1 The Procurer(s) ………………… [Insert “(jointly)”, in case <strong>of</strong> multiple Procurers] may<br />

from time to time during the Operating Period, but only if the Available Capacity with<br />

respect to the Procurer(s) has not been one hundred percent (100%) <strong>of</strong> the Aggregate<br />

Contracted Capacity even <strong>for</strong> one continuous period <strong>of</strong> at least three (3) hours during any<br />

last three (3) continuous months, request the relevant Control Centre to assess the <strong>Power</strong><br />

Station’s Net Capacity. Such capacity assessment <strong>of</strong> the <strong>Power</strong> Station, by the Control<br />

Centre at the request <strong>of</strong> the Procurer(s), shall not be done more than once in a continuous<br />

period <strong>of</strong> six (6) Months.<br />

5.5.2 If the <strong>Power</strong> Station’s Net Capacity after such capacity assessment is determined to be<br />

less than the sum total <strong>of</strong> all contracted capacities <strong>of</strong> the <strong>Power</strong> Station having duration <strong>of</strong><br />

contracts in excess <strong>of</strong> one year, then the provisions <strong>of</strong> Article 5.6.1 shall apply and the<br />

……………………….. [Insert “Seller” if Seller is NOT a Trading Licensee, or “Seller<br />

or Developer” if Seller is a Trading Licensee] shall have a right to demonstrate to the<br />

satisfaction <strong>of</strong> the Control Centre the <strong>Power</strong> Station’s Net Capacity only after a period <strong>of</strong><br />

six (6) Months from the date <strong>of</strong> such assessment..<br />

5.5.3 If the …………………… [Insert “Seller” if Seller is NOT a Trading Licensee, or<br />

“Developer” if Seller is a Trading Licensee] wishes to take any unit <strong>of</strong> the <strong>Power</strong> Station<br />

or the <strong>Power</strong> Station, out <strong>of</strong> service <strong>for</strong> repair be<strong>for</strong>e any assessment by the Control<br />

Centre, it shall in<strong>for</strong>m the Control Centre in writing be<strong>for</strong>e its scheduled start <strong>of</strong> the<br />

repairs and the estimated time required to complete the repairs. The Parties shall then<br />

schedule a maintenance outage in accordance with the Grid Code to enable the Seller to<br />

carry out those repairs and in such a case, the Procurer(s) requiring the Control Centre to<br />

conduct the assessment, shall defer such assessment until such unit or the <strong>Power</strong> Station<br />

is returned to service following that maintenance outage.<br />

5.6 Derating<br />

5.6.1 Based on the assessment carried out by the Control Centre, if the <strong>Power</strong> Station’s<br />

Assessed Capacity is less than the sum total <strong>of</strong> all contracted capacities <strong>of</strong> the <strong>Power</strong><br />

Station having duration <strong>of</strong> contracts in excess <strong>of</strong> one year, the ………………….. [Insert<br />

“Seller” if Seller is NOT a Trading Licensee, or “Developer” if Seller is a Trading<br />

Licensee] shall not be permitted to declare the Available Capacity <strong>of</strong> the <strong>Power</strong> Station at<br />

a level greater than its Assessed Capacity, in which case:<br />

a) The <strong>Power</strong> Station’s Net Capacity shall be reduced to its most recent Assessed<br />

Capacity and Quoted Capacity Charges <strong>for</strong> the Aggregate Contracted Capacity shall<br />

be paid with respect to such reduced <strong>Power</strong> Station’s Net Capacity until the next<br />

assessment by the concerned Control Centre.<br />

b) Further, the Quoted Non–Escalable Capacity Charge shall be reduced by the<br />

following:<br />

Rs. 0.25/kwh x [1 – (Assessed Capacity <strong>of</strong> the <strong>Power</strong> Station)/<strong>Power</strong> Station’s Net<br />

Capacity)];<br />
