SECTION 8<br />

SPECIAL <strong>REGULATIONS</strong><br />

8.11.1.3 All subdivision applications, which contain a total of 10 acres or more, shall be<br />

designed in accordance with the requirements of Section 8.20 of the Zoning<br />

Regulations, Flexible Residential Development, where 50% or more of the total<br />

area to be subdivided is contained within the Open Space and Recreation<br />

Map. The Commission may waive this requirement where soil conditions<br />

clearly prevent a reduction in the minimum lot size outlined within the<br />

underlying zone, as required in Section 5 of these Regulations or where no<br />

new road construction is proposed.<br />

8.11.1.4 All subdivision applications, which contain a total of 10 acres or more, shall be<br />

designed in accordance with the requirements of Section 8.20 of the Zoning<br />

Regulations, Flexible Residential Development, where 25% or more of the total<br />

area to be subdivided is contained within the Open Space and Recreation Map<br />

and identified as agricultural land. A minimum of 25% of the required open<br />

space shall be the agricultural land area. The Commission may waive this<br />

requirement where soil conditions clearly prevent a reduction in the minimum<br />

lot size outlined within the underlying zone, as required in Section 5 of these<br />

Regulations or where no new road construction is proposed.<br />

8.11.1.5 Where a proposed subdivision includes an area containing a significant stream<br />

or a stream linkage as shown on the Open Space and Recreation Map, the<br />

applicant shall, where possible, preserve as open space the stream and an<br />

area located within two hundred feet from either side of the center line of the<br />

stream. Streams under this section include, but are not limited to: the East<br />

and West branch of the Salmon Brook; Dismal Brook; Mountain Brooks; Higley<br />

Brook; Kendall Brook; Kendall Brook; Hungary Brook; Bissell Brook; Ring<br />

Brook; and Belden Brook. This preservation area will be required as part of the<br />

fifty percent (50%) FRD, or twenty percent (20%) conventional subdivision<br />

requirement.<br />

8.11.1.6 Where a proposed development includes an area containing an existing trail or<br />

trail linkage, the trail and an area located within 50 feet from either side of the<br />

centerline of the trail shall be preserved. The Commission may agree to a<br />

relocation of any existing trail, provided the relocation is made in consideration<br />

of environmentally sensitive areas and is attached at both ends with the<br />

original trail.<br />

8.11.1.7 Where a proposed development includes an area abutting an existing trail,<br />

which can be used for a future trail linkage, an area for a new or connecting<br />

trail shall be preserved, together with a land area of 50 feet from either side of<br />

the centerline of the proposed trail.<br />
