SECTION 8<br />

SPECIAL <strong>REGULATIONS</strong><br />

8.3.1 The sale of alcoholic beverages under any permit other than a hotel permit,<br />

restaurant permit, manufacture permit for brew pub, package store permit,<br />

grocery permit, special outing facility permit or Farm Winery Liquor permit is<br />

prohibited.<br />

8.3.2 The provisions of this Section shall not be deemed to be retroactive except<br />

that any building or premises legally in use for the sale of alcoholic liquors in<br />

contravention of this Section, which is not used for such non-conforming use<br />

for a period of six (6) months, shall thereafter conform to these Regulations.<br />

8.4 SPECIAL COMMERCIAL ASSEMBLY USE<br />

Special Commercial Assembly uses; (as defined in Section 8.4.2) are allowed<br />

by Special Permit in Residential Zones subject to the following requirements.<br />

8.4.1 Design and Operating Criteria<br />

Design and operating criteria governing the location of a commercial recreation<br />

use shall include the following:<br />

8.4.1.1 A special commercial assembly use may be granted only on a tract of land<br />

containing more than fifty (50) acres and located in a Residential Zone (R2A or<br />

R50).<br />

8.4.1.2 No structure or recreational activity except single-family dwellings shall be less<br />

than 100 feet from the nearest public highway and each such structure or<br />

activity shall conform to highway and each such structure or activity shall<br />

conform to such side and rear line requirements as deemed necessary by the<br />

Commission based on proposed use.<br />

8.4.1.3 Off-street parking shall be provided as required in Section 7. No parking area<br />

shall be located less than 100 feet from a public highway and, where located<br />

less than 100 feet from any other property line, shall be protected by a<br />

landscaped buffer strip which shall be not less than forty (40) feet wide.<br />

8.4.1.4 The volume of sound from music and public address systems shall be so<br />

controlled as to prevent objectionable noise off the premises.<br />

8.4.1.5 Serving of food and refreshments out of doors shall terminate at 9 p.m. and all<br />

other outdoor activities shall terminate at 10 p.m.<br />

8.4.1.6 Banquets, meetings, stage presentations and dancing shall be held inside a<br />

structure, but this shall not prevent presentation outside a structure of athletic<br />

exhibitions or contests requiring outdoor facilities.<br />
