SECTION 8<br />

SPECIAL <strong>REGULATIONS</strong><br />

8.4.3.1 The applicant may submit and the Commission may approve minor<br />

amendments to an approved Special Permit provided that any amendments<br />

that extend the limits or the number of kinds of activities or buildings shall not<br />

be approved until after a public hearing.<br />

8.4.3.2 Unless otherwise extended by the Commission, approval of a special<br />

commercial assembly use shall become null and void two (2) years after<br />

approval unless a substantial part of the facilities is in operation.<br />

8.4.4 Conformance with Regulations<br />

The provisions of this Section shall not be deemed to be retroactive with<br />

regards to continuance of existing commercial assembly uses. However, any<br />

existing use, which is discontinued for a period of one (1) year, shall thereafter<br />

conform to these Regulations.<br />

8.4.5 Structure Defined<br />

For purposes of this Section a structure shall be defined as: a building, a tent<br />

covering more than 100 square feet of ground and a solid fence or wall over<br />

six (6) feet high but excluding utility poles, flag poles and highway bridges.<br />

8.5 ACCESSORY APARTMENT<br />

8.5.1 Accessory Apartment<br />

The Commission may grant a special permit for the provision of one (1)<br />

accessory apartment in an existing single-family dwelling provided:<br />

8.5.1.1 The owner of the property subject to the permit shall reside on the premises in<br />

the residential structure subject to this permit throughout the duration of the<br />

permit. The permit shall become null and void and the apartment eliminated at<br />

such time that the owner ceases to live on the premises as required.<br />

8.5.1.2 The Building Official shall make a determination as to whether or not the<br />

accessory apartment can be reasonably constructed in compliance with the<br />

building code and may require that the applicant make any necessary<br />

modifications to the primary structure to assure that the building and unit are<br />

safe for the inhabitants.<br />

8.5.1.3 An accessory apartment shall contain at least 450 square feet.<br />

8.5.1.4 The apartment shall have its own outside access convenient to the parking<br />

area and vehicular and pedestrian access to the lot.<br />

8.5.1.5 The apartment shall be equipped with its own bath and kitchen.<br />
