SECTION 8<br />

SPECIAL <strong>REGULATIONS</strong><br />

8.21.9.6 Industrial printing establishments engaged in plate making, commercial<br />

lithography, photoengraving and gravure.<br />

8.21.9.7 Self-service storage facilities.<br />

8.21.9.8 Furniture stripping operation.<br />

8.21.9.9 Underground storage tanks for any hazardous material, except as provided in<br />

Sections 8.21.4.2, 8.21.4.5 and 8.21.4.6.<br />

8.21.9.10 Any existing business operation, which becomes a legal non-conforming use,<br />

in whole or in part, through the prohibitions outlined in Section 8.21.9, may be<br />

expanded or upgraded and underground storage tanks replaced, following the<br />

issuance of a Special Permit by the Commission.<br />

8.21.10 Waiver Provision<br />

The requirements outlined in Sections 8.21.5 and Section 4 of these<br />

Regulations may be modified or waived by the Commission for applications<br />

where the underlying zone is R-30, R-50, or R2A. No modification or waiver<br />

shall be issued until such time that a Public Hearing is held before the<br />

Commission and a written narrative of the proposed use is filed.<br />

8.21.11 The Zoning Board of Appeals shall not be permitted to grant use<br />

variances in the Aquifer Protection Zone.<br />

8.22 HOME INSTRUCTION<br />

8.22.0 Home instruction which involves the training of more than 3 students at any<br />

one time as an accessory to a primary residential use may be allowed by the<br />

Commission subject to the following requirements in addition to the requirements<br />

of Section 8.2: Any Customary Home Instruction, involving the<br />

training of 3 or fewer students at any one time may be considered a<br />

Customary Home Occupation, provided said use conforms to Section 8.8.<br />

8.22.1 An application for Home Instruction shall identify any and all areas of the<br />

property where the instruction will be undertaken. Such areas to include areas<br />

within the home as well as any outbuildings or outside areas.<br />
