SPECIAL <strong>REGULATIONS</strong><br />

8.26.9 Abandonment<br />

A wireless telecommunication site not in use for 12 consecutive months; shall<br />

be removed by the service facility owner. This removal shall occur within 90<br />

days of the end of such 12-month period. Upon removal the site shall be<br />

restored to its previous appearance and where appropriate re-vegetated to<br />

blend with the surrounding area. An appropriate cash bond, as determined by<br />

the Commission shall be submitted as surety before a building permit is<br />

issued.<br />

8.26.10 Expiration of Permit<br />

The approval of an application for special permit shall be void and of no effect<br />

unless construction of the project commences within one year and is<br />

completed within two years from the date of the approval granted by the<br />

Commission. For purposes of this regulation the term start of construction shall<br />

be defined as the installation of a permanent building foundation. The<br />

Commission may grant up to two six-month extensions of the period to start<br />

construction upon written request by the applicant. The Commission shall not<br />

approve an extension unless the development plan is brought into<br />

conformance with any relevant zoning regulations that have been amended<br />

subsequent to the original approval and unless the applicant provides<br />

adequate evidence that construction is able to begin within the extended time<br />

period sought.<br />

8.27 ACTIVE ADULT RESIDENTIAL DEVELOPMENT<br />

8.27.1 Purpose<br />

The purpose of this section is to allow for greater flexibility and variety in the<br />

development of housing for persons who are 55 years of age and older. This<br />

section allows for variations in density, home construction, and site layout<br />

while promoting a high standard of design and livability. This section provides<br />

design guidelines and encourages the construction of a community where<br />

those who are 55 and older can maintain an independent lifestyle among<br />

supportive friends and neighbors. An Active Adult Residential Development<br />

(AARD) shall be designed with recognition of the character of any adjacent<br />

residential neighborhoods, developments within the ED Zone and the town as<br />

a whole. The AARD shall be designed with specific recognition of the<br />

population to be housed.<br />

The site infrastructure as well as the individual residential units, which will be<br />

privately maintained, shall be designed with consideration for the cost of<br />

maintenance and longevity. The site design shall preserve natural site<br />

features and provide open spaces in a manner that benefits the residents and<br />

with regard to the placement of the individual units.<br />
