SPECIAL <strong>REGULATIONS</strong><br />

8.20.12.3 Maintenance of agricultural activity on the site.<br />

8.20.12.4 Future management of special habitat (flora and fauna) areas.<br />

8.20.12.5 The impact on ground and surface water quality.<br />

8.20.12.6 Protection of historic sites or sites of prehistoric or archaeological significance.<br />

8.20.12.7 Compliance with all requirements of Section 8.2 of the Regulations.<br />

8.20.12.8 The degree to which recreational corridors are employed to facilitate the<br />

creation of a town wide network.<br />

8.20.13 Approval<br />

8.20.14 Conditions<br />

The Commission shall approve the Special Permit for Flexible Residential<br />

Development or approve it with conditions necessary to protect the public<br />

health, safety, convenience and property values, if it finds that the<br />

development plan on balance will better serve the Town of Granby and the<br />

neighborhood surrounding the development than a Standard Subdivision<br />

development.<br />

The Commission may establish conditions in addition to those outlined in<br />

Section 4.2.10, including but not limited to the following:<br />

8.20.14.1 Granting of a covenant or easement to ensure that existing fields or pastures<br />

will be plowed or mowed periodically with attention given to the requirements<br />

of existing animal and plant species.<br />

8.20.14.2 Granting of an easement providing and defining rights of public access.<br />

8.20.14.3 Designation of no-cut or limited-clearing areas on lots.<br />

8.20.14.4 Measures to ensure the maintenance of scenic views and vistas.<br />

8.20.14.5 Requiring evidence that at least two (2) organizations are willing to accept the<br />

responsibility for the preservation and maintenance of the Open Space.<br />

8.20.15 Recording<br />

The applicant shall record on the Granby Land Records all legal documents<br />

required to ensure the permanent preservation of the open space prior to the<br />

Commission’s execution of the final mylars, unless otherwise noted within the<br />

Commission’s approval.<br />
